Terms and Conditions

Before registering as an Account Holder of the EC- Ship Online Portal ("Online Portal"), please carefully read the Terms and Conditions, the Privacy Statement and the Disclaimer, which constitute an Agreement between you and the Government of the Hong Kong as represented by the Postmaster General ("HKP"). When you click "agree" at the end of this page, you acknowledge that you have read and fully understood this Agreement. In consideration of the provision of the Services by HKP, you agree to observe and be bound by the terms and conditions of the Services as follows:
1. REGISTRATION FOR EC-SHIP ONLINE PORTAL ACCOUNT
1.1 Upon registration as an Account Holder of the Online Portal, you become a registered user of the Online Portal and hold an Account ("Account"). You represent, undertake and warrant to HKP that:-
 
(a) the Personal Information you have submitted to HKP is true, accurate and up-to-date ;
(b) you have submitted your own Personal Information and not that of any other Person to HKP;
(c) you shall notify HKP of any change in your Personal Information by updating your Account or in writing;
(d) you shall take full responsibility for your Account and any actions taken through your Account.
1.2 Suspension and Termination of Account
  HKP may, at its absolute discretion, suspend or terminate your Account and deny your access to or use of the Online Portal or any part thereof without prior notice in any of the following circumstances:
 
(a) any of your Personal Information is untrue, inaccurate, incomplete or out of date (or HKP has reasonable grounds to suspect that this is the case); and/or
(b) HKP has reason to believe that you have used the Online Portal illegally, improperly or not in accordance with this Agreement.
2. YOUR RESPONSIBILITIES FOR SECURITY
2.1 To ensure that only you are able to access and give instructions to HKP relating to your Account, you will adopt, and at all times maintain, the security procedures prescribed by HKP from time to time including without limitation those set out in Clause 2.3.
2.2 To enable you to use the Online Portal, you can create a Login Name and Password for your Account. You shall be fully responsible for the confidentiality and security of such information, and for all actions taken through your Account. You hereby agree to (a) promptly notify HKP of any unauthorised use of your Login Name and Password in accordance with Clause 9; and (b) properly log out from your Account when you have finished using the Services or when you do not use the Services.

2.3 Password Security Procedures
 2.3.1 You will change your Password regularly and whenever HKP requires you to do so. You shall not choose a Password you have used before;
 2.3.2 When choosing your Password, you shall not use easily guessed numbers or words to avoid unauthorised use of your Account;
 2.3.3 You shall take all steps to safeguard your Password at all times. You shall not disclose your Password to any other Person or permit any other Person to gain access to the Services. You shall not disclose your Password to anyone who claims to represent HKP or holds out as the authorised representative of HKP in any circumstances;
 2.3.4 You shall not record your Password in a way which is recognizable by someone else as a security code;
 2.3.5 If you discover or suspect any unauthorized disclosure or use of your Password, you shall immediately give formal notice in writing to HKP in accordance with Clause 9.
2.4 Other Security Safeguard
 2.4.1 You shall not leave your Computer System unattended while using your Account. You shall promptly log out from your Account once you have finished using the Services or when you do not use the Services.
 2.4.2 You shall not access your Account from any device connected to a local area network (or LAN), such as an office environment, without first making sure that no one else is able to observe or obtain access to your Account pretending to be you.
 2.4.3 You shall not use or attempt to use your Account for any purposes other than those which are permitted by HKP
 2.4.4 You shall not, nor shall you attempt to, tamper with, modify, decompile, disassemble, reverse engineer, damage, alter or gain unauthorized access to any part of the Services or the Online Portal or any software comprised in it. You shall notify HKP as soon as practicable if you become aware of any such actions.
3. AUTHORITY TO CARRY OUT INSTRUCTIONS
3.1 You agree that the use of your Password is adequate identification of you. HKP is entitled to act on instructions given through your Account without obtaining further confirmation from you. HKP shall not be liable to any loss or damage in connection with acting on the instructions given through your Account including the case where the instructions are not given or authorised by you.
3.2 You will not be held responsible for any instructions given through your account that are not authorised by you if such instructions are given after you have given HKP formal notice in writing of your discovery or suspicion of unauthorized disclosure or use of your Password in accordance with Clause 2.3.5.
4. THE ONLINE PORTAL AND YOUR SYSTEM
4.1 You shall at your own costs and expenses ensure that Your Computer System is compatible with the Online Portal. HKP will not be liable for any liability, loss, cost and expense that you suffer or incur as a result of any incompatibility between Your Computer System and the Online Portal.
4.2 You shall, at your own cost and expenses, take all necessary measures to ensure that Your Computer System is functioning well and is free from any Virus. You understand and agree that any use of the Online Portal and downloading and/or obtaining of any content and/or software from the Online Portal is entirely your own decision and at your own risk. HKP shall not be responsible for any problem caused by the error, failure or malfunction of Your Computer System or any other computer system resulting from the use of the Online Portal. Also, HKP shall not be responsible in any way for any damage to Your Computer System or any other computer system or any loss of data caused by downloading and/or use of such content and/or software (including but not limited to loss or damage caused by Viruses or malfunctioning of software).
4.3 You represent that you are the holder or authorised user of Your Computer System every time you access or use the Online Portal.
4.4 You agree to use the Online Portal (whether or not it contains materials owned by HKP or provided by others) legally and will not infringe on the Intellectual Property Rights of the Government or other copyright owners in Hong Kong or any other jurisdictions where you access or use the Online Portal.
5. THE ONLINE PORTAL AND THE SERVICES
5.1 The Online Portal and the Materials on the Online Portal are provided on "as-is" and "with all faults" bases. HKP makes no statements, representations or warranties (whether express or implied) of any kind (including but not limited to the accuracy, completeness, timeliness, merchantability, security, non-infringement of the Intellectual Property Rights of any Person and fitness for a particular purpose) in relation to the Online Portal, the Services, the Materials in the Online Portal;and the information available through the Online Portal.
5.2 You acknowledge that the Internet is an inherently unreliable medium of communication and such unreliability is beyond the control of HKP. HKP does not make any statements, representations or warranties (whether express or implied) as to the results or as to the accuracy or reliability of information obtained through the Online Portal or the Services or as to any defects in the Service Software will be corrected.
5.3 HKP shall not in any circumstances or in any way be liable for any loss or damage whatsoever (including consequential, indirect, incidental and special loss/damage) arising out of or in connection with the use or misuse of or inability to use the Online Portal.
5.4 HKP shall not be liable for any loss and damage that you may suffer if the Online Portal is in error, malfunctioning, inoperative, delayed or unavailable due to (but not limited to) any connection failure or computer downtime attributable to housekeeping, malfunctioning, Viruses, unauthorized access by any Person (including hacker), upgrade or preventive or remedial maintenance activities or any events beyond the reasonable control of HKP.
6. OPERATING TIMES, CHANGES AND DISRUPTIONS
6.1 The Online Portal will usually be 24-hours available for use or at such times as notified to you. You accept, however, that routine maintenance requirements, excess demand on the systems and some other circumstances may render the Services unavailable and HKP may suspend the Online Portal at any time.
6.2 In connection with the Online Portal, HKP may at its absolute discretion at any time without prior notice to you to:-
 6.2.1 change the Content or mode of the Online Portal; or
 6.2.2 add to, remove or otherwise change, end or suspend any of the Services, functions or facilities available on the Online Portal ; or
 6.2.3 terminate the Online Portal.
7. TRANSMISSION AND PROCESSING OF INSTRUCTIONS
7.1 You acknowledge that the processing and transmission of your instructions may involve:
 
(a) the transmission of data over various communication networks; and
(b) changes to such data in order to conform or adapt to the technical requirements of connecting networks or devices.
7.2 HKP shall, in no circumstances, be liable for your inability to obtain (in whole or in part) any Services, due to the delay, suspension or failure of any communication networks or any connecting networks or devices or any changes in respect of them.
8. EC-SHIP POSTING METHOD AND PAYMENT
8.1 Sender has to declare the weight of a postal item through his Account. The amount of postage is calculated by the Online Portal based on the weight declared by Sender ("Estimated Postage") and the destination of the postal item.
8.2 Sender may pay for the Estimated Postage online using a credit card, as the shipping label generated will be valid for one month, sender should ensure to have the credit card with at least one month’s validity period before presenting the postal item at counter. Alternatively, he may make a payment by cash, permit mailing deposit account (Require prior application with Financial Services Division of Hongkong Post), EPS or Octopus at a designated post office, where his mail item will be weighed by HKP’s counter staff to ascertain the actual postage payable. Payment by postage stamp or postage label purchased from Postage Label Vending Machine (PLVM) is not applicable.
8.3 The information such as the declared weight of the postal item shown on the shipping label will be verified by HKP's counter staff when the postal item is brought to the post office for posting. The sender shall arrange for weighing of the postal item by HKP's counter staff. The weight of the postal item shown on the electronic scale of HKP shall prevail.
8.4 The actual postage payable will be final subject to the weight of a postal item shown on the electronic scale of HKP, destination of the postal item and the prevailing postage. The total amount of the postage paid will be rounded down to the nearest ten cents according to the verification made at the post office. The following arrangements shall apply if Sender pays for the Estimated Postage online using a credit card. The Sender may click this link for detailed guideline for using credit card.
 8.4.1 In case the weight of the postal item shown on the electronic scale of HKP is the same as the weight shown on the shipping label, the actual postage payable will be the same as the Estimated Postage. Sender does not have to make any top-up payment at the counter in the post office.
 8.4.2 In case the weight of the postal item shown on the electronic scale of HKP is heavier than the weight shown on the shipping label, Sender has to make a top-up payment for the shortfall in the postage at the counter in the post office by cash, permit mailing deposit account (Require prior application with Financial Services Division of Hongkong Post), EPS or Octopus. Payment by postage stamp or postage label purchased from Postage Label Vending Machine (PLVM) is not applicable.
 8.4.3 In case the weight of the postal item shown on the electronic scale of HKP is lighter than the weight shown on the shipping label, the actual postage payable is less than the Estimated Postage at EC ship. Only the actual postage will be charged to sender’s credit card associated with the said postal item.
8.5 If the postal item is not posted at our Post Office counter within the 30-day validity period (from the first date the label is created and saved), the shipping label will expire and be deleted. The estimated postage will not charge to sender’s credit card account. If required, the sender can re-create the transaction.
8.6 HKP shall not be liable to you for or in respect of any loss or damage (including indirect and consequential loss and damage) suffered by you by reason of or in connection with any:
 
(a) failure, delay, interruption, suspension or restriction of the transmission of any information or message from any system or process used, maintained or provided by any relevant banks or payment gateways for processing credit, debit, smart card or other method of payment;
(b) error in or omission from any information or message transmitted by means of the said system or process;
(c) breakdown, malfunction or failure of the said system or process; and
(d) anything arising out of or in connection with the above.
9. NOTICES
9.1 Unless expressly provided otherwise, each notice, demand or other communication given or made by you to HKP under these Terms and Conditions shall be in writing by e-mail to hkpo@hkpo.gov.hk, or by facsimile to 2868 0094 or delivered by hand or courier, or dispatched by prepaid registered post or prepaid post, to Hongkong Post Headquarters, 2 Connaught Place, Central, Hong Kong or such other address as HKP has by at least five (5) days' prior written notice specified to you. Such notices, demands or other communications shall be deemed to have been properly given or made by you as follows:-
 
(a) if sent by facsimile or e-mail, when dispatched;
(b) if delivered by hand or courier, upon delivery to the said address of HKP;
(c) if sent by post, two (2) business days (for local post) and five (5) business days (for overseas post) after the date of posting.
9.2 Unless expressly provided otherwise, each notice, demand or other communication given or made by HKP to you under these Terms and Conditions shall be in writing and delivered by hand or courier, or dispatched by prepaid registered post or prepaid post, or sent by facsimile or email, to your correspondence address, facsimile number or email address (as the case may be) as you have submitted to HKP or such other correspondence address, facsimile number or email address as you have by at least five (5) days' prior written notice specified to HKP. Such notices, demands or other communications shall be deemed to have been properly given or made by HKP as follows:-
 
(a) if sent by facsimile or electronic mail, when dispatched.
(b) if delivered by hand or courier, upon delivery to your correspondence address;
(c) if sent by post, two (2) business days (for local post) and five (5) business days (for overseas post) after the date of posting;
10. COMPLIANCE WITH LAWS
10.1 You agree to comply with all laws, statutes and regulations whether of Hong Kong or elsewhere as applicable to any use of the Services or the Online Portal and/or any transactions conducted through the Online Portal.
11. MODIFICATION
11.1 HKP is entitled to amend the terms of this Agreement at its absolute discretion at any time and from time to time. The amended Agreement will be effective immediately upon its posting on the Online Portal. If you continue to use the Online Portal after the amendment, you agree or will be deemed to agree to be bound by the terms of the amended Agreement. In this regard, you are strongly advised to read this Agreement carefully each time before you use the Online Portal.
12. LIMITATION OF LIABILITY
12.1 Use of the Services and anything on the Online Portal is at your own risk. HKP will not in any event be liable for any direct, indirect, consequential, incidental or other loss or damage (including without limitation, any loss of profit, business or data, and any damage to computer systems or facilities) in relation to the use or misuse of or inability to use the Online Portal.
13. PERSONAL DATA
13.1 You agree that any of your Personal Data collected by HKP through your use of the Online Portal or the Services at any time and from time to time may be used for such purposes and disclosed to such Persons in accordance with HKP's Personal data collection and privacy policies set out in the Privacy Policy Statement published under HKP's website at www.hongkongpost.hk which may be modified from time to time.
14. INDEMNITY
14.1 You shall indemnify HKP and keep HKP fully and effectively indemnified from and against all and any liabilities, losses, damage, costs, charges, expenses (including legal fees), demands, claims, proceedings and actions which HKP may sustain or incur or which may be brought or established against HKP by any Person, and which in any case directly or indirectly arises out of or in connection with any of the following:-
 
(a) your negligence, recklessness or willful misconduct;
(b) your breach or non-performance or non-observance of any provisions of this Agreement;
(c) your breach of any representation or warranty given by you; or
(d) any infringement by you, your agent or contractor of the Intellectual Property Rights of HKP.
14.2 This Clause 14 shall survive the termination of the Services and shall continue in full force and effect notwithstanding such termination.
15. INTELLECTUAL PROPERTY RIGHTS
15.1 Copyright Statement
 15.1.1 You acknowledge and agree that the copyright in the Content is and shall remain at all times the property of HKP.
15.2 Restriction of use of HKP's trademarks and service marks
 15.2.1 You acknowledge that HKP's names and logos including "Hongkong Post" and "EC-Ship" are registered trade or service marks of the Government and you agree not to use such names and logos in any circumstances. "hongkongpost.hk", "https://ec-ship.hongkongpost.hk" and certain graphics, logos, page headers, button icons, scripts, and service names shown in or used on the Online Portal are trade or service marks of the Government and you agree not to use the same for any purpose unless the prior written consent of the Government/HKP has been obtained.
15.3 Right to Download and Copy the Content
 15.3.1 You may download and copy the Content only for the purpose of making enquiries about the Account, updating personal particulars relating to the Account or utilising Online Portal where appropriate. No part of the Content on the Online Portal may be modified, reproduced, stored in a retrieval system, transmitted, copied, distributed or used in any other way for commercial or public purposes without HKP's prior written consent.
15.4 Reservation of Rights
 15.4.1 The Government and HKP reserve any and all rights not expressly granted in these Terms and Conditions in respect of the Content of the Online Portal.
15.5 Infringement
 15.5.1 Unauthorized copying, distribution, modification and public display of copyrighted works is an infringement of the copyright holders' rights. As a condition of your access to the Online Portal, you agree that you will not access or use or permit the Online Portal to be accessed or used for infringing the intellectual property rights of others. Without prejudice to other accrued rights, HKP reserves the right to terminate the registration of any Account Holder upon notice of any infringement of the copyright or other intellectual property rights of others in connection with the access or use of the Online Portal. HKP will investigate any information it receives in relation to copyright infringement committed by any Account Holder or user of the Online Portal.
16. ENTIRE AGREEMENT
16.1 This Agreement constitutes the whole agreement between HKP and you and supersedes any previous agreements, arrangements or understandings between the parties relating to the subject matter hereof. Each of the parties hereto acknowledges and agrees that it has not relied on any statements, undertakings, warranties, representations given or made save for those expressly set out in this Agreement.
17. WAIVER AND SEVERABILITY
17.1 No failure to exercise or delay in exercising of any right or remedy by HKP in respect of any provisions of this Agreement shall operate as a waiver of such right or remedy.
17.2 If any provisions of this Agreement shall be found to be illegal, invalid or unenforceable (whether in whole or in part) under any laws of any competent jurisdiction, such illegality, invalidity or unenforceability shall not affect the remaining provisions of this Agreement, all of which shall remain in full force and effect.
18. GOVERNING LAW AND JURISDICTION
18.1 This Agreement shall be governed by and construed in accordance with the laws of Hong Kong. The parties hereto irrevocably agree that the courts of Hong Kong have exclusive jurisdiction to determine any issue in connection with this Agreement.
19. GOVERNING VERSION
19.1 In case of any conflict or inconsistency arising between the English version and the Chinese version of this Agreement, the English version shall prevail.
20. DEFINITIONS
20.1 Unless the context requires otherwise, the following terms in this Agreement shall have the following meanings respectively.
 20.1.1 "Account" means the online account opened and maintained by HKP in your name for using the Services in accordance with this Agreement.
 20.1.2 "Account Holder" means any person who holds an Account upon registration as a user of the Services.
 20.1.3 "Agreement" means this Agreement which includes these Terms and Conditions, the Privacy Policy Statement and the Disclaimer and as amended, varied or supplemented from time to time.
 20.1.4 "Day" means calendar day.
 20.1.5 "HKP"/ "We"/ "us" means Hongkong Post, the trading name of the Hong Kong Post Office, which is a department of the Government of Hong Kong.
 20.1.6 "Claim" means all claims, liability, damages, losses, costs and expenses, including legal fees.
 20.1.7 "Content" means the content on the Online Portal or a Linked Third Party Website, as the case may be, including the information, text, icons, logos, illustrations, hypertext links, HTML codes, data, trade or service marks, software, music, sound, video clips, audio clips, photographs, designs, graphics, images, still pictures, series of moving pictures (whether animated or not), digital downloads, advertisements, products, goods, services or any compilation or combination of them and any other materials or services on or available from that website.
 20.1.8 "EC-Ship Posting" means posting of a postal item whose postal fees are paid through an Account at the Online Portal.
 20.1.9 "Estimated Postage" means the amount of postage for a postal item intended to be posted by a sender calculated based on the weight declared by the sender at the Online Portal.
 20.1.10 "Hong Kong" means the Hong Kong Special Administrative Region of the People's Republic of China.
 20.1.11 "Intellectual Property Rights" means patents, trademarks, service marks, trade names, design rights, copyright, domain name, database rights, rights in know-how and other intellectual property rights of whatever nature and whosesoever arising, and whether now known or which created in future and in each case whether registered or unregistered and including applications for the grant of such rights.
 20.1.12 "Linked Third Party Website" means any website linked to or accessible by means of the Online Portal.
 20.1.13 "Login Name" means your personal identification for access to or use of the Online Portal.
 20.1.14 "Password" means your personal password for gaining access to the Online Portal.
 20.1.15 "Person" includes an individual, a firm, a corporation, an organisation and an unincorporated body.
 20.1.16 "Personal Data" has the meaning ascribed to it under the Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong).
 20.1.17 "Personal Information" means the personal information that a person is required to submit to HKP for or upon registration as a user of the Services, and where appropriate, means such personal information as updated by the Account Holder at the Online Portal or otherwise notified to HKP.
 20.1.18 "Public Holiday" means every Sunday and any other day which is a general holiday by virtue of the General Holidays Ordinance (Cap. 149 of the Laws of Hong Kong).
 20.1.19 "Services" means the services provided by HKP by means of the Online Portal.
 20.1.20 "Service Software" means any software supplied to you whenever you access the Online Portal and any other software supplied to you for the purpose of accessing the Online Portal from time to time.
 20.1.21 "Related Person" means all and any officers, representatives, employees, agents, sub-contractors and suppliers of HKP.
 20.1.22 "Viruses" means all and any computer virus or similar device or software including without limitation, devices commonly known as software bombs, Trojan horses and worms.
 20.1.23 "Online Portal" means the EC-Ship website operated and administered by HKP at https://ec-ship.hongkongpost.hk as may be modified, replaced or substituted from time to time by HKP.
 20.1.24 "Working Day" means any day other than Saturday or a public holiday.
 20.1.25 "Your Computer System" means all hardware and software system used by you in gaining access to the Online Portal including without limitation, any computer, modem and any program installed therein.
20.2 In this Agreement, unless the context otherwise requires:-
 
(a) words importing the singular shall include the plural and vice versa;
(b) words importing a gender shall include every gender; and
(c) words importing the whole shall include a reference to any part of the whole.
20.3 Any reference in this Agreement to any statute, code, ordinance, regulation, rule or treaty shall be construed as referring to that statute, code, ordinance, regulation, rule or treaty as it may from time to time be amended, modified, replaced or re-enacted from time to time.
20.4 References in this Agreement to clauses and schedules (if any) are to clauses and schedules (if any) to this Agreement except otherwise expressly stated.
20.5 Headings are used in this Agreement for convenience of reference only and shall not in any way vary, limit or extend the interpretation of this Agreement.
DISCLAIMER
This Disclaimer forms part of this Agreement.

The Online Portal is provided by HKP on an "as is"and "as available"basis. HKP does not warrant that the operation of the Online Portal will be uninterrupted or error free. HKP disclaims to the fullest extent permissible by law, all warranties, express or implied, in relation to or in connection with the Online Portal, any Services, requests and transactions conducted via the Online Portal. We do not warrant that the Online Portal is suitable for any particular purpose or that it meets any particular requirements.

The Content of the Online Portal may be inaccurate or have typographical errors. Users agree that the use of the Online Portal is at their own risk.

HKP does not warrant that the Online Portal or the server from which it is made available, or e-mails sent from HKP to Account Holders are free of Viruses or other harmful components. Neither HKP nor any Related Person will be liable for loss or damage arising out of or in connection with the use of the Online Portal or its Contents.

By visiting the Online Portal, you agree to accept unconditionally the terms of this Disclaimer which may be revised from time to time by HKP without prior notice to you.
LINKED THIRD PARTY WEBSITE
From time to time the Online Portal may contain hyperlinks to allow users to access third party websites. HKP does not review, endorse or recommend, and are not responsible for such websites. Such links are provided only for users' convenience. HKP shall not be liable for the contents of such websites nor for any loss or damage, direct or indirect or consequential arising out of or in connection with the use, inability to use or reliance on such websites.
CONTENT IN THE ONLINE PORTAL
Content on the Online Portal is for reference only. Whilst HKP will make reasonable endeavours to ensure the accuracy of the Content, HKP gives no express or implied warranty as to its accuracy, completeness or suitability for any purpose thereof. All liability of HKP howsoever arising for any inaccuracies, incompleteness or unsuitability in the Content is expressly excluded to the fullest extent permitted by law. HKP shall not be liable for any error, omission, misstatement or misrepresentation, express or implied, concerning the Content or any loss or damage, direct or indirect or consequential arising from or in connection with the use, inability to use or reliance on the Content. HKP is entitled to delete, suspend or edit any Content on the Online Portal at any time at its absolute discretion without giving any reason.

Users are responsible for making their own assessment of website materials and contents. Users are advised to verify such information and obtain independent advice before relying on it if they consider it necessary.
EXCLUSION OF CERTAIN CATEGORIES OF LOSS
Neither HKP nor any Related Person will be liable for any Claims including but not limited to the following categories of loss:
(a) any economic loss (including loss of business opportunity, goodwill, contracts, revenue, profit or anticipated savings);
(b) loss of goodwill or injury to reputation;
(c) indirect, special or consequential loss or damage; or
(d) loss of data.

regardless of the form of action, whether in contract, strict liability or tort (including negligence), and regardless of whether HKP or the Related Person knew or had reason to know of the possibility of the loss, injury or damage in question.
GOVERNING VERSION
In case of any conflict or inconsistency between the English version and the Chinese version of this Disclaimer, the English version shall prevail.

e-Express+
GENERAL INFORMATION
1. Each set of shipping label for e-Express+ Service consists of a customs declaration form (CN22), postal code, sender's information and an addressee's information.
2. To minimise the possibility of delay in delivery, detention or seizure by customs in the destination country/region ("Destination Customs Authorities") or in return due to non-delivery, senders must provide detailed and truthful description (i.e. particulars, value, quantity and weight or volume, etc.) of the contents of the postal item on the shipping label. A false or misleading declaration may lead to a fine and/or confiscation of the postal item by the Destination Customs Authorities.
3. No postal items in a consignment should bear a return address outside of Hong Kong or enclose any mail sent on behalf of other senders. If return address is not available on a postal item, it may lead to mistaken delivery, non-delivery, or destruction of the postal item due to the inability to return to sender.
4. Each postal item must be affixed with a set of shipping label generated through the EC-Ship Online Portal for e-Express+.
5. The format and size of the shipping label are jointly determined by the destinations' postal administrations and HKP in order to facilitate mail processing. Senders should print the shipping label using the default size option of the Online Portal. Any adjustment made to the size of shipping label may lead to failure in barcode scanning and subsequently mail delivery. HKP shall assume no responsibility for any consequential losses.
6. It is recommended that the shipping label be printed with a laser printer to facilitate barcode scanning by HKP's computer system. If the barcode on the shipping label fails to be read by the computer system upon item acceptance, the postal item may not be processed further.
PROHIBITED AND RESTRICTED POSTAL ITEMS
7. Please refer to the "Post Office Guide" for details of prohibited and restricted items for respective destinations. It is the sender's responsibility to enquire into the import and export regulations (e.g. prohibitions, restrictions including quarantine, pharmaceutical restrictions, etc.) and the documents required (e.g. commercial invoice, certificate of origin, health certificate, license, authorisation for goods subject to quarantine [plant, animal, food products, etc.]) in the destinations.
POSTING METHOD AND PAYMENT
8.1 Sender has to declare the weight of a postal item through his Account. The amount of postage is calculated by the Online Portal based on the weight declared by Sender ("Estimated Postage") and the destination of the postal item.
8.2 Before posting, Sender is required to segregate mail items by referring to shipping labels imprinted with an indicator (which is an Office of exchange name, i.e. New York (JFK) and others (including San Francisco (SFO), Los Angeles (LAX), Chicago (ORD) and Miami (MIA). Any unsegregated mail items or items with old shipping labels (i.e. without the indicator) will not be accepted for posting.
8.3 Sender may pay for the Estimated Postage online using a credit card, as the shipping label generated will be valid for one month, sender should ensure to have the credit card with at least one month's validity period before presenting the postal item at counter. Alternatively, he may make a payment by cash, permit mailing deposit account (Require prior application with Financial Services Division of Hongkong Post), EPS or Octopus at a designated post office, where his mail item will be weighed by HKP's counter staff to ascertain the actual postage payable. Payment by postage stamp or postage label purchased from Postage Label Vending Machine (PLVM) is not applicable.
8.4 The information such as the declared weight of the postal item shown on the shipping label will be verified by HKP's counter staff when the postal item is brought to the post office for posting. The sender shall arrange for weighing of the postal item by HKP's counter staff. The weight of the postal item shown on the electronic scale of HKP shall prevail.
8.5 The actual postage payable will be final subject to the weight of a postal item shown on the electronic scale of HKP, destination of the postal item and the prevailing postage. The total amount of the postage paid will be rounded down to the nearest ten cents according to the verification made at the post office. The following arrangements shall apply if Sender pays for the Estimated Postage online using a credit card. The Sender may click this link for detailed guideline for using credit card:
8.5.1 In case the weight of the postal item shown on the electronic scale of HKP is the same as the weight shown on the shipping label, the actual postage payable will be the same as the Estimated Postage. Sender does not have to make any top-up payment at the counter in the post office.
8.5.2 In case the weight of the postal item shown on the electronic scale of HKP is heavier than the weight shown on the shipping label, Sender has to make a top-up payment for the shortfall in the postage at the counter in the post office by cash, permit mailing deposit account (Require prior application with Financial Services Division of Hongkong Post), EPS or Octopus. Payment by postage stamp or postage label purchased from Postage Label Vending Machine (PLVM) is not applicable.
8.5.3 In case the weight of the postal item shown on the electronic scale of HKP is lighter than the weight shown on the shipping label, the actual postage payable is less than the Estimated Postage at EC ship. Only the actual postage will be charged to sender's credit card associated with the said postal item.
8.6 For payment by cash, EPS or Octopus, the overpaid postage will only be refunded in cash to the Sender when there was item paid / topped up at counter within the same transaction day. Also, the refund amount should be limited to the amount paid at post office. If the refund is made after the transaction day, HKP will issue the cheque with the refund amount to the Sender.

For payment by permit mailing deposit account, the overpaid postage will be refunded to the Sender via relevant permit mailing deposit account.
8.7 If the postal item is not posted at our Post Office counter within the 30-day validity period (from the first date the label is created and saved), the shipping label will expire and be deleted. The estimated postage will not charge to sender's credit card account. If required, the sender can re-create the transaction.
8.8 HKP shall not be liable to you for or in respect of any loss or damage (including indirect and consequential loss and damage) suffered by you by reason of or in connection with any:
 
(a) failure, delay, interruption, suspension or restriction of the transmission of any information or message from any system or process used, maintained or provided by any relevant banks or payment gateways for processing credit, debit, smart card or other method of payment;
(b) error in or omission from any information or message transmitted by means of the said system or process;
(c) breakdown, malfunction or failure of the said system or process; and
(d) anything arising out of or in connection with the above.
LATEST TIME OF POSTING
9 All post offices (except mobile post offices) can accept mail prepared by EC-Ship posting (including e-Express+ mail). Please refer to Post Office Guide for the addresses of the post offices.
10. For posting of 20 or above nos. of e-Express+ Service items, the latest time of posting is 4 pm.
DELIVERY SPEED
11. The normal delivery speed for a postal item using e-Express+ Service ("e-Express+ Service item") is 7 to 14 working days *, subject to delay due to mail processing, flight availability, progress of customs clearance and aviation security check. The delivery speed is for reference only. There is no guarantee as to the delivery time of e-Express+ Service items.

* Sundays and public holidays are excluded for the purpose of determining the date of posting or arrival in Hong Kong for all mail items and for performance measurement under the performance pledges.
DELAY DUE TO COMPUTER SYSTEM ERROR
12. In the event of error in HKP's computer system, mail processing procedures are subject to delay.
SIGNATURE ON COLLECTION
13. e-Express+ Service is not the same as Air Registered Mail. The addressee's signature is not required at the time of collection of a postal item.
PROOF OF DELIVERY
14. Proof of Delivery (POD) is not available for an e-Express+ Service item.
ENQUIRY OF POSTAL ITEM
15. No enquiry service other than online tracking will be provided. e-Express+ service provides four tracking events: (1) Acceptance at counter; (2) Handed over to the carrier / Left for destination; (3) Arrival at overseas mail processing centre; and (4) Delivered, on the websites of HKP or of destination postal administrations within six months from the date of posting. Instead of contacting HKP, the sender should trace his/ her items on the aforesaid websites within six months from the date of posting. HKP only accepts indemnity claims for total loss of an item.
LIABILITY FOR LOSS
16. HKP shall not be liable to any person for any loss of any postal item if the claim made by the sender is reasonably suspected by HKP to be fraudulent.
17. HKP shall not be held liable to any person for any loss of postal items. Nevertheless, at HKP's absolute discretion, compensation on an ex-gratia basis may be payable in respect of total loss of postal items in the following manner:
  In case the successful delivery status or the attempted delivery status of an e-Express+ Service item is still not displayed on the websites of destination postal administrations (or on the website of HKP, whichever shows the latest status of a mail item) within two months after the date of posting, the item will be considered a total loss.

If HKP is satisfied that direct loss has been sustained by the claimant as a result of the total loss of the item, an indemnity up to the following limits is payable to the claimant:
 
(i) HK$1,000 (for any item weighing 500g or above); or
(ii) HK$500 (for any item weighing less than 500g).
  The amount of indemnity shall be:
 
(i) the item value declared on the shipping label; or
(ii) the maximum amount of indemnity (i.e. (i) HK$1,000 (for any item weighing 500g or above); or (ii) HK$500 (for any item weighing less than 500g)); or
(iii) the value shown on the purchase invoice /receipt, and / or the transaction record of the articles lost (or in case of documents, the replacement cost);
  whichever is the lowest among the three, but excluding any indirect loss or loss of profit. Under no circumstances will the postage be refunded to the claimant.
  The claimant should provide the receipt/invoice to substantiate the value of contents/the replacement cost of documents, which should tally with the information stated on the shipping label.
18. No refund of postage shall be made to the claimant under any circumstances.
19. The sender may claim for indemnity from HKP for total loss of an item within two to four months after the date of posting. Late submission of claims will not be entertained under any circumstances. All claims should be submitted together with the following documents:
 
(a) Application Claim Form for e-Express+ Service Item (The sender can download the Application Claim Form from the EC-Ship online portal or prepare his/her own claim application form, provided that the information on and the format of the self-prepared application claim form are the same as the one downloaded from the online portal);
(b) Original or copy of Declaration of Non-receipt of e-Express+ Service Item (The sender can download the Declaration from the EC-Ship online portal or prepare his/her own declaration form, provided that the information on and the format of the self-prepared declaration form are the same as the one downloaded from the online portal);
(c) Original of the Certificate of Posting downloaded from the EC-Ship Online Portal. The details of the post office as well as the date and time of acceptance of the item are shown on the Certificate of Posting;
(d) A copy of the purchase invoice / receipt and / or the transaction record (e.g. Paypal, eBay, Bank record, etc). A stamped or signed invoice or an electronic invoice of the mail item with full description of the contents, quantity, value, merchant's name, merchant's address, merchant's telephone number, invoice number and invoice issuance date. The claimant should provide the relevant invoice/receipt to substantiate the value of the mail item, which should tally with the information stated on the shipping label. (if the above mentioned copy of the invoice or receipt is not available, please provide other supporting documents that can substantiate the value of the mail content);
(e) A copy of a valid Business Registration Certificate (for an item posted under the name of a company); and
(f) Enquiries can be made through the following channels to submit the form
  1. Login EC-Ship Online Portal and fill the Online Enquiry Form, or
  2. Email to the Mail Tracking Office at mto@hkpo.gov.hk, or
  3. Mail to Hongkong Post Mail Tracking Office

  4. By Fax to: 2543 0469
20. It will take two months for HKP to handle the application upon receipt of the required documents mentioned in Clause 19, and four months to finalise the related indemnity (if applicable).
21. HKP has the right to reject any compensation claim if there is any discrepancy between the information on the Certificate of Posting submitted by the sender and HKP's records.
22. Certificate of Posting is available for download from the Online Portal within six months from the date of posting. HKP does not undertake to provide duplicates or to search records of posting in the case of loss of or damage to the Certificate of Posting caused by sender.
23. Although the claimant has submitted the completed claim application form and the necessary supporting documents listed in paragraph 19 above, HKP reserves the right to make decision on whether the compensation is payable to the claimant. As a result, submission of a claim application does not mean that the claim is approved.
24. Notwithstanding paragraph 17 above, no investigation will be conducted by HKP and no compensation whatsoever will be payable by HKP to the sender in the following cases. The sender shall not make any claim for compensation in the following cases:
 
(a) Delay, return or confiscation of postal items resulting from customs clearance. The Customs will only inform the address about the progress of customs clearance;
(b) fine, charges or tax to be paid by the sender as requested by customs;
(c) sending items destined to the following destinations: Mexico, South Africa;
(d) failure of customs clearance or seizure or detention of postal items by customs authorities resulting from unclear description (e.g. sample, merchandise without detailed description of items) or false, misleading or incomplete declaration;
(e) delay, loss or damage of postal items caused by disaster, political risk, strike, nuclear explosion, war or any event of force majeure beyond the reasonable control of Hongkong Post;
(f) postal items containing any of the prohibited items listed in the Post Office Guide;
(g) partial or complete damage of the postal item;
(h) delay in delivery of the postal item except as already declared as total loss;
(i) partial or entire content missing of the postal item;
(j) return of the postal item for any reason;
(k) incorrect address, incorrect posting or incorrect delivery.
25. A posting receipt only serves as a temporary receipt recording the quantity of a postal item and the postage paid to HKP. It will not be accepted as a supporting document for enquiries and claims as there is no detailed posting information such as declared value of item, sender's address and delivery address.
26. If there is any discrepancy in the mail tracking events provided by the destinations' postal administrations (or by HKP, whichever is the latest) and the addressee, the information provided by the destinations' postal administrations (or by HKP, whichever is the latest) shall prevail.
27. Compensation, if any, will be paid to the sender only.
NON- DELIVERY
28. A postal item which cannot be delivered overseas will normally be returned to the sender in due course. Any such return is governed by the regulations and arrangements of the destinations' postal administrations. Neither HKP nor the overseas post office is liable to state the reason of return. Sender cannot re-post the returned item for free or request for refund of postage. The sender shall not dispute the reason of return, unavailability of the reason of return, the means of return or the processing time for return.
29. No mail tracking service and compensation are available for (i) a postal item returned to Hong Kong from overseas, or (ii) a postal item which is shown to have been returned to Hong Kong but not yet received by the sender on the websites of the destinations' postal administrations (or of the website of HKP, whichever shows the latest status of a mail item).
30. No compensation shall be payable for any loss of postal items during the return process.
RECALL, DETENTION OR DIVERSION OF POSTAL ITEMS
31. No postal item, once handed to any officer of HKP in the course of his/her duty, may be requested to be taken out of the post, regardless of the identity of the requestor. Nor can any postal item be detained or delayed despite any request marked on the packing of the postal item. All postal items will be forwarded to the specified address. No postal item will be diverted to any other address or any other addressee at the request of the sender. Applications for inserting articles to a postal item will not be entertained.
LIABILITY OF HKP
32. HKP is only responsible for forwarding sender's postal items to the addressee at the destination, and shall not be liable for the contents of any consignment, including the sender's information, the addressee's information and the content of the item. HKP is not liable for providing, revising or supplementing any information regarding the consignment. The sender shall be fully liable for possessing or sending fake items or prohibited items found by any government or regulatory authorities at the destination country/region. HKP shall not be liable to any person in this respect.
33. Sender must acknowledge that all contents of his postal item are subject to inbound search and inspection by the customs authorities in the destination country/region. For the avoidance of doubt, HKP shall not be liable to any person for any destruction, loss or damage of the postal items while in the custody of the customs authorities.
INSURANCE SERVICE
34. Optional insurance is available (except mail items destined to Mexico and South Africa) at a flat premium of HK$9 per postal item with a maximum coverage of HK$5,000. The terms mentioned at clause 19 and 24 above also apply to this optional insurance service (e.g. the compensation is limited to the total loss of a mail and no postage refund for the loss of a mail, etc.).
35. The optional insurance is marketed by by Jardine Lloyd Thompson Ltd. and underwritten by Assicurazioni Generali S.p.A (Hong Kong Branch). Any purchase of such insurance shall be a direct dealing between the sender and the said companies. For the avoidance of doubt, HKP shall not be liable to any person for any claims or disputes arising out of or in relation to such insurance.
36. In any event, the maximum amount of compensation for any loss shall not exceed the declared item value.

Registered Mail
GENERAL CONDITIONS
1. It is recommended that the shipping label be printed with a laser printer to facilitate barcode scanning by HKP's computer system. If the barcode on the shipping label fails to be read by the computer system upon item acceptance, the postal item may not be processed further.

It is your responsibility to enquire into import and export regulations (prohibitions, restrictions such as quarantine, pharmaceutical restrictions, etc.) and to find out what documents, if any (commercial invoice, certificate of origin, health certificate, licence, authorization for goods subject to quarantine [plant, animal, food products, etc.]) are required in the destination.
EC-SHIP POSTING METHOD AND PAYMENT
4.1 Sender has to declare the weight of a postal item through his Account. The amount of postage is calculated by the Online Portal based on the weight declared by Sender ("Estimated Postage").
4.2 Sender may pay for the Estimated Postage online using a credit card. Alternatively, he may make a payment by cash, permit mailing deposit account (Require prior application with Financial Services Division of Hongkong Post), EPS or Octopus (Only available in post offices installed with Octopus facility) at a designated post office, where his mail item will be weighed by HKP’s counter staff to ascertain the actual postage payable. Payment by postage stamp or postage label purchased from Postage Label Vending Machine (PLVM) is not applicable.
4.3 The information such as the declared weight of the postal item shown on the shipping label will be verified by HKP's counter staff when the postal item is brought to the post office for posting. The sender shall arrange for weighing of the postal item by HKP's counter staff. The weight of the postal item shown on the electronic scale of HKP shall prevail.
4.4 The actual postage payable hinges on the weight of a postal item shown on the electronic scale of HKP. The total amount of the postage paid will be rounded down to the nearest ten cents according to the verification made at the post office. The following arrangements shall apply if Sender pays for the Estimated Postage online using a credit card:
 4.4.1 In case the weight of the postal item shown on the electronic scale of HKP is the same as the weight shown on the shipping label, the actual postage payable will be the same as the Estimated Postage. Sender does not have to make any top-up payment at the counter in the post office.
 4.4.2 In case the weight of the postal item shown on the electronic scale of HKP is heavier than the weight shown on the shipping label, Sender has to make a top-up payment for the shortfall in the postage at the counter in the post office by cash, EPS or Octopus (Only available in post offices installed with Octopus facility). Mixed payment of cash, EPS or Octopus (Only available in post offices installed with Octopus facility) will also be accepted at the post office. Payment by postage stamp or postage label purchased from Postage Label Vending Machine (PLVM) is not applicable.
 4.4.3 In case the weight of the postal item shown on the electronic scale of HKP is lighter than the weight shown on the shipping label, the actual postage payable should be less than the Estimated Postage paid. The overpaid postage will not be refunded to the Sender at the counter. Sender has to apply for refund of the overpaid postage on the Online Portal after posting. The overpaid postage will be refunded to Sender's credit card account from which the Estimated Postage was paid. The refund process may take about 2 to 4 months after the date of application.
4.5 For payment by cash, EPS or Octopus (Only available in post offices installed with Octopus facility), the overpaid postage will only be refunded in cash to the Sender when there was item paid / topped up at counter within the same transaction day. Also, the refund amount should be limited to the amount paid at post office. If the refund is made after the transaction day, Hongkong Post will issue the cheque with the refund amount to the Sender.

For payment by permit mailing deposit account, the overpaid postage will be refunded to the Sender via relevant permit mailing deposit account.
4.6 Any incomplete shipping label will be deleted after 30 days (from the first date the label is created and saved).
4.7 Shipping labels paid online are valid for posting within 30 days from the payment date. Please ensure that a valid shipping label is used for posting. In case a shipping label expires, it can no longer be used.
4.8 HKP shall not be liable to you for or in respect of any loss or damage (including indirect and consequential loss and damage) suffered by you by reason of or in connection with any:
 
(a) failure, delay, interruption, suspension or restriction of the transmission of any information or message from any system or process used, maintained or provided by any relevant banks or payment gateways for processing credit, debit, smart card or other method of payment;
(b) error in or omission from any information or message transmitted by means of the said system or process;
(c) breakdown, malfunction or failure of the said system or process; and
(d) anything arising out of or in connection with the above.
LATEST TIME OF POSTING
5. A total of 125 post offices accept Air / Surface Registered Mail sent through EC-Ship. Please refer to Post Office Guide for the addresses of the post offices.
6. For posting of 20 or more Air / Surface Registered Mail items sent through EC-Ship, the latest time of posting is 4 pm.
DELAY DUE TO COMPUTER SYSTEM ERROR
7. In the event of error in HKP's computer system, mail processing procedures are subject to delay.
ENQUIRY OF POSTAL ITEM
8. Registered Mail can be traced 2 weeks to a maximum of 5 months after the date of posting. All enquiries and claims have to be supported by the Certificate of Posting and other relevant documents.
9. On some occasions, overseas postal administrations may take two months to complete their tracing enquiries for letters and packets and four months to finalize the compensation, if any. HKP will endeavor to follow up with overseas postal administrations for an early reply.
10. Enquiries can be made through the following channels: -
 
(a) access HKP's website at www.hongkongpost.hk, or
(b) call the enquiry hotline of the Track and Trace System at 2921 2560, or
(c) complete the enquiry form (Pos 28B) or the attachment to the leaflet Pos 815, which is obtainable at any post office. Certificate of Posting which shows the name of the post office, date and time of counter's acceptance of the postal item should also be submitted.
11. If possible, a facsimile of the envelope or the address of the postal item should be furnished with the enquiry.
12. HKP reserves the right to ask the sender to provide a written declaration of non-receipt of postal item from the recipient in case of dispute.
LIABILITY FOR LOSS
13. A maximum sum of HK$320 and the charges and fees paid, but excluding the registration charge would be payable by HKP, for the loss or theft of or damage to the content of Air / Surface Registered Mail whilst in HKP's custody according to the regulations of the Universal Postal Union.
  Compensation for loss or theft of or damage to the content of a registered packet will be:
 
(i) the declared value shown in the shipping label downloaded from the Online Portal;
(ii) the maximum compensation amount (i.e. $320) or;
(iii) the true value of the postal item or the value shown in the invoice (or in the case of documents, the replacement cost) of the postal item whichever is the lowest,
  the above three values whichever is the lowest.
  Claimant should submit the relevant invoice to prove the value of the content of the Registered Mail, and the value of content shown on the invoice should tally with the value of the content shown in the Certificate of Posting.

No compensation will be paid in respect of :-
 
(a) Any postal item which has been compulsorily registered, or which has not been posted in the prescribed manner;
(b) Any postal item which has been lost through a cause beyond HKP's control;
(c) Any postal item which HKP cannot account for in consequence of the loss of official documents such as shipping label, Certificate of Posting and relevant invoice through a cause beyond control;
(d) Any postal item confiscated by Customs or any competent authority in the destination;
(e) Any postal item containing a prohibited article and the item has been confiscated or destroyed by Customs or any competent authority because of the content;
(f) Any postal item in respect of which an enquiry is not made within five months from the date of posting.
(g) Any delay in delivery.
14. Subject to the same conditions prescribed by the Universal Postal Convention, member countries of the Universal Postal Union accept liability in respect of registered postal items lost, pilfered or damaged whilst in their custody. However, some individual operators do not accept any liability for total loss, partial loss or partial damage to contents of registered items. Details are given under the individual entry of the destination in the Appendix of the Post Office Guide.
15. On the transfer of a registered postal item to another postal administration, the responsibility of HKP ceases. Compensation is not payable in respect of a registered postal item which is lost after transfer to another postal administration, unless that administration decides that compensation shall be paid by HKP.
16. If the postal item considered to be lost is subsequently found or has been delivered to the recipient, the sender should repay the compensation amount to HKP.
17. Compensation, if any, will be paid to the sender only.
NO REFUND OF POSTAGE
18. Full information regarding articles that can and that cannot be sent by post is published under the proper heads in the Post Office Guide. No application will be entertained for the refund of the value of postage stamps on correspondence which is discovered, after the postage stamps have been obliterated, to contain any prohibited article, or which exceeds the limit of weight, or which for any other reason cannot be forwarded and has consequently to be returned to the sender, and any loss resulting from a non-observance of the rules by the sender of an article must be borne by him.
LIABILITY OF HKP
19. HKP is only responsible for forwarding sender's postal items to the addressee at the destination, and shall not be liable for the contents of any consignment, including the sender's information, the addressee's information and the content of the item. HKP is not liable for providing, revising or supplementing any information regarding the consignment. The sender shall be fully liable for possessing or sending fake items or prohibited items found by any government or regulatory authorities at the destination operators. HKP shall not be liable to any person in this respect.
20. Sender must acknowledge that all contents of his postal item are subject to inbound search and inspection by the customs authorities in the destination operators. For the avoidance of doubt, HKP shall not be liable to any person for any destruction, loss or damage of the postal items while in the custody of the customs authorities.

Speedpost (Standard Service)
1. Customer should pay attention to the specific posting requirements of the destination, e.g. delivery standard, Customs declaration form, prohibited/restricted items, weight/size limit and points to note. Details.
2. Customer shall ensure that 3 copies of the posting form (Pos 460E) are printed and signed before posting the item. Sender shall not make any changes on the printed posting form (Pos 460E). In case of necessary amendment, sender shall make the adjustment in this platform, print and sign all 3 copies of the new posting form (Pos 460E).
3. Each posting form will be assigned a unique Item Number. Customer must ensure that all the posting items must be attached with the unique posting form. To facilitate barcode scanning, it is recommended to print all 3 copies of the posting form (Pos 460E) by laser printer. Collection officer will test on site the readability of the barcode imprinted on all 3 copies of the posting form (Pos 460E). If the barcode fails to be read by barcode scanner, the posting item will not be processed further.
4. To facilitate processing of the postal item, the particulars of the sender and addressee as well as the contents of the postal item should be clearly indicated such that the possibility of delay in delivery, detention or seizure by the customs authorities in the destination country/territory ("Destination Customs Authorities"), return due to non-delivery may be minimized.
5. In addition to the posting form (Pos 460E), senders may have to complete additional customs declaration form(s) to be attached to the postal item as required by the destination country/territory. For example, if the value of the content is over HK$3,000, the upper part of a completed CN22 form (Pos 401G) should be affixed to the postal item and submitted together with a completed CN23 form (Pos 401C) upon posting. Details.
6. To facilitate customs clearance by the Destination Customs Authorities, please clearly indicate in the posting form (Pos460E) details of the postal item contents, for example:
 
(a) detailed description, quantity and unit measurement of each article therein (e.g. two men's cotton shirts), especially for articles such as plants, animals, food products, etc. which are subject to customs inspection and quarantine;
(b) net weight of each article therein (in kg);
(c) total weight of the postal item (in kg); and
(d) the value of each article and the total value of the postal item. Please indicate the currency used, e.g. HK$ for Hong Kong dollars.
7. Failure to complete the posting form (Pos 460E) and any other necessary customs declaration form(s) may result in delay in mail processing and inconvenience to the addressee. The posting form (Pos 460E) and/or any other customs declaration form(s) containing false or misleading declaration may lead to a fine or to confiscation of the postal item by the Destination Customs Authorities.
8. Senders should be aware of the latest requirements of documents and customs clearance procedures stipulated by the Destination Customs Authorities. The Destination Customs Authorities may withhold and/or impose customs duties/tariffs on any postal items as they consider lawful under the law of their own country. It is the responsibility of the senders/addressees to provide all the required documents (such as commercial invoice, certificate of origin, health certificate, license, authorization for controlled goods (e.g. plants, animals, food products, etc.) which are subject to customs inspection and quarantine) for customs clearance of the postal item or arrange broker service if necessary. Such documents be put in an adhesive transparent envelope and be securely fastened to the postal item. The Destination Customs Authorities will not inform the postal administrations, i.e. Hongkong Post, of the customs clearance information concerning the postal items.
9. For postal item which are merchandise or samples, The HS tariff number (8-digit) must be filled in according to the Harmonized Commodity Description and Coding System developed by the World Customs Organization. In this regard, "country of origin" means the country from which the goods originate (including production, manufacturing or assembling). To avoid any delay and inconvenience caused to the addressee, the sender should provide such information and attach an invoice to the postal item for processing by the customs officials.
10. Customer can pack the items with self-provided packing or Multipack Boxes purchased at their choices, but shall make sure that all the printed posting forms (Pos 460E), customs declaration forms and relevant document shall be inserted into an adhesive / open flap transparent envelope and have it securely attached on the posting item.
11. The total weight of the item is subject to measurement by Hongkong Post. If there is any discrepancy, Hongkong Post's measurement shall be final. Calculation of the postage fee will accordingly be based on Hongkong Post's final measurement without prior notice to sender.
12. Subject to the conditions stipulated in the "Post Office Guide", compensation may be payable by Hongkong Post in respect of the loss of, damage to or delay in delivery of the postal items on an ex-gratia basis. Full refund of postage paid is made in case of delay in delivery for one day or more. Compensation may be payable in accordance with the declared value shown in the Posting Form (Pos460E) up to a maximum of HK$1,500 if it is proved to the satisfaction of Hongkong Post that direct loss has been sustained by the claimant as a result of loss of or damage to the postal item or delay in delivery for not less than 7 working days. No compensation or postage refund is payable in the case of delay in delivery or confiscation resulted from customs clearance (duration of customs clearance will be calculated in full days). Any enquiries regarding the postal item must be made within three months from the date of posting. The time required to respond to such enquiries and requests for information will depend on responses from the postal authorities of the destination country/territory. Details.
13. Sender may insure the postal item with Speedpost Insurance prior to posting. Please select "Speedpost Insurance" to clearly indicate whether or not you request Speedpost Insurance for your postal item. If you have to make a claim, you are required to approach the insurance company concerned direct. Each claim is subject to the terms and conditions as specified in the "Notes of Speedpost Insurance", which is available at all post offices. In the case of loss or total damage to an insured postal item covered under Speedpost Insurance, Hongkong Post will refund the postage paid in full but will not make any compensation.
14. Any other part of the Posting Form (Pos460E) does NOT constitute conclusive evidence of the contents of the postal item.
15. Speedpost delivery standard is based on the actual working days in the destination country/territory, excluding the day of posting and the time taken for customs clearance. Details.
16. According to the usual practice of postal administrations worldwide, delivery staff will not call the recipient before mail delivery and normally only one delivery attempt will be made to the recipient's address. Should there be no one to collect the mail item at the recipient's address, a notification card will be left to the recipient for collection of the mail item at a designated post office.
17. Personal Information Collection Statement
 
(a) The personal data provided in this address pack will be used by Hongkong Post for processing the mail item. It is voluntary for customer to provide the relevant personal data. The posting details including the personal data may be transmitted via electronic data interchange to the overseas postal administrations which have a business relationship with Hongkong Post, and Destination Customs Authorities. Failure to provide the related data shall affect processing of the mail item, and Hongkong Post is unable to fulfil the required service. The personal data includes without limitation the information such as sender / addressee's name, residential and company address, telephone number and e-mail address, etc. Hongkong Post would not use the personal data for any other purposes without customer prior consent unless such use is permitted or required by law. Except that, Hongkong Post's general policy is to disclose no personal identifiable information to third parties except as required by law.
(b) You have the right to request access to and correction of your personal data in accordance with Sections 18 and 22 and Principle 6 in Schedule 1 to the Personal Data (Privacy) Ordinance (Cap. 486). Your right of access includes the right to obtain a copy of your personal data as provided in this Address Pack. For access and correction, please complete the "Data Access Request Form" (Pos 736) which is available at any post office.

Air / Surface Parcel
GENERAL CONDITIONS
1. No items should bear a return address located outside Hong Kong or enclose mail sent on behalf of other senders in the consignment.
POSTING FORM
2. Only 3 copies of posting form (Delivery Receipt, Customs Declaration and Addressee’s Copy), instead of 4 copies, are required. All the signed posting forms shall be inserted into an adhesive/open flap transparent envelope and have it securely attached on the posting item.
3. It is recommended that the shipping label be printed with a laser printer to facilitate barcode scanning by HKP's computer system. If the barcode on the shipping label fails to be read by the computer system upon item acceptance, the postal item may not be processed further.
PROHIBITED AND RESTRICTED ITEMS
4. Please refer to Post Office Guide for details on the prohibited and restricted items in respective destinations. Your goods may be subject to restrictions. It is your responsibility to enquire into import and export regulations (prohibitions, restrictions such as quarantine, pharmaceutical restrictions, etc.) and to find out what documents, if any (commercial invoice, certificate of origin, health certificate, licence, authorization for goods subject to quarantine [plant, animal, food products, etc.]) are required in the destination country.
ENQUIRIES ABOUT LOSS OR NON- DELIVERY
5. Enquiries about outward parcels must be made within five months from the date of posting. An enquiry about the loss or non-delivery of an insured/ordinary parcel should be made at the office of posting.
6. On some occasions, overseas postal administrations may take two months to complete their tracing enquiries for parcels and four months to finalize the compensation, if any. HKP will endeavor to follow up with overseas postal administrations for an early reply.
7. Enquiries can be made through the following channels: -
 
(a) access HKP's website at www.hongkongpost.hk, or
(b) call the enquiry hotline of the Track and Trace System at 2921 2560, or
(c) complete the enquiry form (Pos 28B) or the attachment to the leaflet Pos 815, which is obtainable at any post office. The Certificate of Posting which shows the name of the post office, date and time of counter's acceptance of the postal item should also be submitted.
8. If possible, a facsimile of the envelope or the address of the packet should be furnished with the enquiry.
9. HKP reserves the right to ask the sender to provide a written declaration of non-receipt of mail item from the recipient in case of dispute or anomalous enquiries received.
NON DELIVERY OF PARCELS
10. A parcel which cannot be delivered abroad is normally returned to the sender in due course (that is, after expiry of the normal period of which it may be held at the disposal of the addressee in the country of destination), without previous notification, unless he has requested otherwise at the time of posting. The sender of an undeliverable parcel which is returned either by air or surface route is responsible for the return charges. The sender of a parcel which has been abandoned, sold or destroyed in the country of destination is also responsible for any charges which may subsequently be raised by the postal administration of that country.
11. The return charges on an undeliverable parcel include postage, generally equivalent to the outward charge, as in many case charges levied abroad for warehousing and so on. Custom duty raised on a parcel abroad is generally cancelled if the parcel is returned.
12. Directions should always be given as to what is to be done with a parcel if it cannot be delivered. Space is provided for this purpose on the multi-part address pack for overseas parcels (Pos 652). If a dispatch note is used, the instructions as to disposal must be written on form CP71 (Pos 402) as well as on the dispatch note and form CP71 stuck on the cover of the parcel. Senders may select to return/redirect the parcel by air or surfaced. If the selected mode of conveyance is not available at the country of destination, the parcel will be returned by the most appropriate means in use. Undeliverable parcels which cannot be returned to the sender are liable to be disposed of after two months.
13. In addition, it should be note that the option for the return to sender in the vent of non-delivery either forthwith or at the end of a stated period will not necessarily have any practical effect in the case of a parcel addressed Poste Restante (or En Gare, as in the case may be) or to a place where parcels are not addressed to the door, but have to be collected from the Post Office.
DELAY DUE TO COMPUTER SYSTEM ERROR
14. In the event of error in HKP’s computer system, mail processing procedures are subject to delay.
LIABILITY
15. The sender of a parcel which has not been delivered to the addressee has to pay the conveyance and other costs incurred as a result of non-delivery even if the parcel has been abandoned, sold or destroyed, and the Post Office reserves the right to collect a deposit in advance to cover such costs.
CUSTOMS DECLARATION AND DESPATCH NOTE
16. All parcels for places abroad are liable to be opened for examination in the country of destination and contents are subject to the customs, assay, trade mark and other legal requirements of the country destination. The sender of a parcel is accordingly required to make an accurate declaration of the nature and value of the contents. Completion of customs declarations is the responsibility of the sender alone. Customs declaration forms for this purpose can be obtained beforehand at any post office. The forms should be filled up in ink, but where more than one copy is required carbon copies may be used. Senders are recommended to avoid the use of abbreviations, ditto marks and so on which may not be intelligence in the country of destination. The impression of a rubber stamp is not sufficient signature for such declarations and in the case of a parcel sent by a firm, if the declaration is not signed by a responsible member of the firm it must be signed thus – A.B. clerk to ..... If the contents are not fully described or are under-valued, the parcel is liable to seizure and penalties may be incurred. The declaration should be made out in English and also, when the country of destination requires in the appropriate foreign language. Exceptionally, parcels for Macau, Chinese Mainland and Taiwan may be declared in Chinese characters.
INSURED PARCEL AND UNINSURED PARCEL (OVERSEAS)
GENERAL
17. The Post Office is not legally liable for the loss, damage, delay, non-delivery or misdelivery of anything sent by post, whether insured or not, or to pay compensation in respect of an insured parcels or its contents.
18. The Post Office does not enter into a contract of carriage or of insurance either express or implied. It accepts postal items for transmission by post, under, and subject to, the provisions of the Post Office Ordinance, and the Regulations and Rules made thereunder.
19. The Post office is not liable when the sender’s actions may be suspected of fraudulent intent, aimed at receiving compensation.
20. Nevertheless, compensation was paid for the loss or theft or damage to postal parcels subject to compliance with the conditions regarding fastening, sealing, packing, marking and so on indicted under the respective mail services and the regulations shown below.
21. In case of liability, consequential losses or loss of profits will not be taken into account in the indemnity to be paid; The Post Office will in no case be liable above the limits provided for in the Universal Postal Union.
CONVENTION AND REGULATION
22. Under the Regulations, the decision of the Postmaster General on all questions of compensation shall be final and conclusive.
23. Unless the contrary is specially stated, the following regulations apply:
  • The compensation paid for the content of a parcel will not exceed the declared item value, or the value shown in the purchase invoice /receipt, and / or the transaction record of the articles lost (or in case of documents, the replacement cost), or the amount of the damage sustained, whichever is the lowest. No compensation is paid for indirect loss or loss of profits. The right is reserved of reinstating the contents of a parcel instead of paying compensation.
  • The Post Office must be satisfied that the loss or damage occurred in the post.
  • In the case of damage or loss of contents the parcel should be retained for inspection as nearly as possible in the state in which it was delivered.
  • If complaint is made that the contents of a parcel have been abstracted, the cover must be produced.
  • All claims for compensation must be supported by the original or photocopy of the certificate of posting for the items concerned. The Post Office cannot undertake to provide duplicate or to search records or posting particulars in respect of certificates of posting lost or destroyed by senders.
INSURED PARCELS
24. Condition governing payment of compensation
  In general, under international regulations any compensation payable for the loss of or damage to an insured parcel or an uninsured parcel is paid to the sender. Exceptionally, certain postal administrations may pay compensation to the addressee for damage to or loss from a parcel (insured or uninsured) if the addressee makes reservations when the parcel is delivered, in which case no compensation is payable to sender. The sender of parcel (insured or uninsured) may waive his claim in favour of the addressee, or a third party. The Post Office pays compensation for the loss of or damage to an insured parcel or an uninsured parcel or its contents, if it is established that the loss or damage has occurred while the parcel was in the custody of the Post Office.

On the transfer of the parcel to another postal administration, the responsibility of Hongkong Post ceases. Compensation is paid by Hongkong Post in respect of any parcel which is lost or damaged after transfer to another postal administration only if that administration decides that compensation shall be paid.

The compensation paid for the content of an insured parcel will not exceed the declared item value, or the value shown in the purchase invoice /receipt, and / or the transaction record of the articles lost (or in case of documents, the replacement cost), or the amount of the damage sustained, whichever is the lowest. No compensation is paid for indirect loss or loss of profits. Nor will compensation exceed the amount for which the parcel was insured. In case of loss, total theft from or total damage to an insured parcel, the charges and fees paid, with the exception of the insurance charge will be refunded to the sender or the addressee as appropriate. The right is reserved of reinstating the contents of a parcel instead of paying compensation.

In any application for compensation for damage or loss of contents, the item should be retained for inspection as nearly as possible in the condition in which it was delivered.

The onus of making up properly any parcel sent by post and of packing adequately any article or articles enclosed therein lies upon the sender, and the Post Office does not accept any responsibility for loss, theft of damage, arising from faulty or inadequate packing or fastenings or seals, detachment of tie-on label, incomplete or incorrect address and so on or for any failure to observe defects in these respects at the time of posting.

The Post Office is under no legal liability to pay compensation in respect of any parcel for which an insurance fee has been paid.

Under international regulations no compensation will be paid in respect of:-
 
(1) Any parcel which has been compulsorily registered, or which has not been posted in the prescribed manner;
(2) Any parcel which has been lost through a cause beyond control, generally speaking where no question of negligence arises;
(3) Any parcel which Hongkong Post cannot account for in consequence of the loss of official documents through a cause beyond control;
(4) Any parcel confiscated under the internal legislation of the country to which it is addressed;
(5) Any parcel containing a prohibited article if the item has been confiscated or destroyed by Customs or some other competent authority because of the contents;
(6) Any outward parcel in respect of which an enquiry is not made within five months from the date of posting;
(7) Any parcel containing an article of a type specified under some destinations for which compensation will not be paid;
(8) Any parcel containing coin, bullion or jewellery not packed in accordance with the special regulations;
(9) Any parcel lost or damaged in course of post by the fault or negligence of the sender, such as failure to provide adequate packing having regard to the nature of the contents;
(10) Any damage to an exceptionally fragile article which from its nature cannot reasonably be expected to travel by post, such as a clay figure, a soapstone or alabaster model, a collection of butterflies or months, a vacuum flask, and so on ; or
(11) Any parcel fraudulently insured for a sum greater than the actual value of the contents.
UNINSURED PARCELS (OVERSEAS)
25. The Post Office pays compensation for the loss or theft or damage of an uninsured parcel posted to overseas. In case of loss, total theft from or total damage to an uninsured parcel, full refund of postage and express fee (if applicable) paid will also be made. However, no compensation will be paid in respect of:
  any parcel which has been lost or has sustained damage or loss of contents through a cause beyond control;

loss, theft or damage which has been caused by the fault or negligence of the sender or arises from the nature of the contents;

any parcel which the Post Office cannot account for in consequence of the loss of official documents through a cause beyond control;

any parcel confiscated under the internal legislation of the country to which it is addressed;

any parcel containing a prohibited article if it has been confiscated or destroyed by Customs or some other competent authority because of the contents; and

any local/outward parcel in respect of which an enquiry is not made within five months from the date of posting.
26. Compensation is paid in accordance with the provisions of the Parcel Post Regulations of the Universal Postal Union. It varies according to the weight of the parcel. However, the actual compensation paid for the content of an uninsured parcel paid will not exceed the declared item value, or the value shown in the purchase invoice /receipt, and / or the transaction record of the articles lost (or in case of documents, the replacement cost), or the amount of the damage sustained, whichever is the lowest. No compensation is paid for indirect loss or loss of profits. The right is reserved of reinstating the contents of a parcel instead of paying compensation.
REFUND OF POSTAGE
27. Full information regarding articles that can and that cannot be sent by post is published, under the proper heads in this Guide. No application will be entertained for the refund of the value of postage stamps on correspondence which is discovered, after the postage stamps have been obliterated, to contain any prohibited article, or which exceeds the limit of weight, or which for any other reason cannot be forwarded and has consequently to be returned to the sender, and any loss resulting from a non-observance of the rules by the sender of an article must be borne by him.
MODIFICATION
28. HKP is entitled to revise this Agreement at its absolute discretion at any time and from time to time by posting the amended Agreement. The amended Agreement will be effective immediately upon its posting on this Website. If you continue to use the Service after such amended Agreement, you agree or will be deemed to agree to be bound by the amended Agreement. In this regard, you are strongly advised to read this Agreement carefully each time before you use the Service.
PERSONAL DATA
29. Provision of personal data in response to HKP's request is required for provision of the required service. All the posting details including the personal data may be transmitted via electronic data interchange to the overseas postal administrations which have a business relationship with HKP and the transit as well as destination countries' Customs Authorities. If you do not provide the Personal Data, HKP will be unable to provide the required service. Personal data include without limitation the information such as sender / addressee's name, residential and company address, telephone number and e-mail address.
30. HKP will not be legally liable for any losses, damages, claims, actions, proceedings, demands, costs of expenses arising out of or caused by any disclosure or divulgence by HKP, its employees, contractors and agents of any person's personal data to any party.
31. You have the right to request access to and correction of your personal data in accordance with Sections 18 and 22 and Principle 6 in Schedule 1 to the Personal Data (Privacy) Ordinance (Cap. 486). Your right of access includes the right to obtain a copy of your personal data as provided in this Address Pack. For access and correction, please complete the "Data Access Request Form" (Pos 736) which is available at any post office.
RESTRICTION ON USE OF HONGKONG POST’S TRADE AND SERVCIE MARKS
32. You acknowledge that HKP's names and logos including "Hongkong Post" and "EC-Ship" are registered trade marks of Hongkong Post and you agree not to use such names and logos in any circumstances.
WAIVER AND SEVERABILITY
33. No failure to exercise or delay in exercising of any right or remedy by HKP in respect of any provisions of this Agreement shall operate as a waiver of such right or remedy.
34. If any provisions of this Agreement shall be found to be illegal, invalid or unenforceable (whether in whole or in part) under any laws of any competent jurisdiction, such illegality, invalidity or unenforceability shall not affect the remaining provisions of this Agreement, all of which shall remain in full force and effect.
GOVERNING LAW AND JURISDICTION
35. This Agreement shall be governed by and construed in accordance with the laws of Hong Kong. The parties hereto irrevocably agree that the courts of Hong Kong will have exclusive jurisdiction to determine any issue in connection with this Agreement.
GOVERNING VERSION
36. In case of any conflict or inconsistency arising between the English version and the Chinese translation of this Agreement, the English version shall prevail.

Smart Post
1. DEFINITION
Unless the context otherwise requires or permits, the following expressions shall have the following meanings:
(a) "Call-for Notification" means the SMS messages or emails sent by PMG to inform the mail recipient ("the Recipient") that he/she has to collect the postal item at a designated post office as the postal item cannot be dropped into a letter box under the Mail Delivery Service.
(b) "Charges" means the Postage payable by the Customer for the Smart Post Service.
(c) "Collection Notification" means the SMS messages or emails sent by PMG to inform the Recipient that the postal item is ready for collection at a designated post office under the Counter Collection Service.
(d) "Counter Collection Service" means the service provided by the PMG to the Customer in relation to the posting and collection of a postal item as described in clause 4 of these Conditions of Service.
(e) "Customer" means the party requesting the provision of the Smart Post Service by the PMG.
(f) "Delivery Notification" means the SMS messages or emails sent by PMG to inform the Recipient of the delivery result of the postal item.
(g) "Mail Delivery Service" means the service provided by the PMG to the Customer in relation to the posting and delivery of a postal item as described in clause 3 of these Conditions of Service.
(h) "Smart Post Service" means the Smart Post Service provided by the Postmaster General ("the PMG") in accordance with the terms and conditions as hereinafter appearing. Delivery under the Smart Post Service can be a Mail Delivery Service or a Counter Collection Service
(i) "Smart Post Service leaflet" means the service leaflet issued by the PMG for the Smart Post Service.
2. GENERAL TERM
(a) Customer wishing to use the Smart Post Service should register himself as a user of the EC-Ship Online Portal and holds an Account of the Portal. The Customer can then order the Smart Post Service via the EC-Ship Online Portal ("Order"). The PMG will only accept the Order via the EC-Ship Online Portal.
(b) Payment of the Charges for the Smart Post Service shall be made by credit card in the same manner as the payment methods for the EC-Ship Online Portal Services. The PMG will only process the Customer’s Order for the Smart Post Service upon full payment of the Charges in accordance therewith. Payment by postage stamp or postage label purchased from Postage Label Vending Machine (PLVM) is not applicable.
(c) An Order will be treated as being accepted by the PMG upon the display of the Order confirmation page via the EC-Ship Online Portal to the Customer.
(d) Once an Order is accepted by the PMG, the Order is irrevocable.
(e) If any address label is not printed within thirty (30) days after it is prepared at EC-Ship Online Portal, or any address label is not used on the postal item and posted within five (5) days after it is printed, the address label will become invalid. The estimated postage will not charge to sender's credit card account. If required, the sender can re-create the transaction.
(f) The Customer shall provide to the PMG the correct email addresses for both the Customer and the designated recipient ("the Recipient") for receiving the email notification to the Customer ("the Email Notification") and the postal item delivery/ collection notification ("the Delivery/ Collection Notification") or call-for notification ("the Call-for Notification") to the Recipient, and other necessary information. The PMG shall not be responsible for any failure or delay in sending the Email Notification, the Delivery/ Collection Notification or the Call-for Notification caused by any inaccurate or incomplete information provided by the Customer.
(g) If the Customer chooses Hongkong Post to contact the designated Recipient by email, the Customer shall provide to the PMG the correct email addresses of the Recipient for receiving the postal item delivery/ collection notification ("the Delivery/Collection Notification") or call-for notification ("the Call-for Notification"), and other necessary information. The PMG shall not be responsible for any failure, delay or misdirection in sending the Delivery/Collection Notification or the Call-for Notification caused by any inaccurate or incomplete information provided by the Customer. Under exceptional circumstances, the Customer may make only one request to change the email address of the Recipient after the item is posted and accepted at the post office counter, and the change request must be made before the delivery is made. Notwithstanding any other provisions in these Terms and Conditions, the PMG is entitled to reject any change request without giving any reason. The Customer shall take full responsibility for any consequences resulting from any misdirection, failure or delay in sending the Delivery/Collection Notification or the Call-for Notification caused by any inaccurate or incomplete information provided by the Customer.
(h) If the Customer chooses Hongkong Post to contact the designated Recipient by SMS, the Customer shall provide to the PMG the correct mobile phone number of the Recipient which can receive SMS messages regarding the postal item delivery/collection notification ("the Delivery/Collection Notification") or call-for notification ("the Call-for Notification"), and other necessary information. The PMG shall not be responsible for any failure, delay or misdirection in sending the Delivery/Collection Notification or the Call-for Notification caused by any inaccurate or incomplete information provided by the Customer. Under exceptional circumstances, the Customer may make only one request to change the mobile phone number of the Recipient after the item is posted and accepted at the post office counter, and the change request must be made before the delivery is made. Notwithstanding any other provisions in these Terms and Conditions, the PMG is entitled to reject any change request without giving any reason. The Customer shall take full responsibility for any consequences resulting from any misdirection, failure or delay in sending the Delivery/Collection Notification or the Call-for Notification caused by any inaccurate or incomplete information provided by the Customer.
(i) If the Email Notification, Delivery/ Collection Notification or Call-for Notification has been sent to the Customer's or the Recipient’s (as the case may be) designated email address from the server of the PMG or PMG’s service provider, or have been otherwise provided by PMG, PMG shall not be held liable if the Customer suffers loss due to any failure or delay to receive the Email Notification, Delivery/ Collection Notification or Call-for Notification.
(j) Neither PMG, the Government, nor any of the telecommunications companies which may be designated by PMG for the purposes of providing the Email Notification, Delivery/ Collection Notification and Call-for Notification will be liable for any failure or delay in transmitting information to the Customer or Recipient or any error in such information. In particular, neither PMG, the Government, nor any such telecommunications companies shall be held liable for any of the consequences arising from any force majeure event or any other cause beyond the reasonable control of PMG, the Government, or such telecommunications company including without limitation the failure of the Customer's telecommunications equipment to receive information for whatever reasons, any telecommunications breakdown, mechanical failure, path failure, malfunction, technical breakdown, interruption or accuracy of equipment or installation.
(k) The PMG shall not be held liable for any loss or damage that may be caused to the Customer's or Recipient’s data, software, computer, telecommunications equipment or other equipment in their use of the Smart Post Service.
(l) The third parties (including without limitation, telecommunications companies, systems operators and internet service providers) supporting the Smart Post Service are not agents or partners of PMG and do not represent the PMG. There is no agency, partnership, joint venture or other relationship between these third parties with PMG. PMG is not liable for any losses or damages, direct, indirect or consequential caused by any acts or omissions of the third parties.
3. MAIL DELIVERY SERVICE
(a) For Mail Delivery Service, the PMG will deliver the postal item to the letter-box of the Recipient.
(b) If the postal item cannot be dropped into a letter-box, the Recipient will receive the Call-for Notification.
(c) The Recipient shall set a collection code ("the Code") upon the receipt of the Call-for Notification via the hyperlink available in the Call-for Notification. The Recipient shall provide the Code and corresponding item number for verification when collecting the postal item at the post office. The Recipient shall keep the Code confidential and shall not disclose it to any third party before picking up the postal item from the post office. The PMG shall not be liable for any loss, damage or expense suffered or incurred as a result of or incidental to the loss or disclosure of the Code to any third party by the Recipient.
(d) Any postal item which is not collected within fourteen (14) days after the date of the Call-for Notification will be returned to the Customer by the PMG. The Customer hereby acknowledges and authorizes the PMG to return the postal item to the Customer.
4. COUNTER COLLECTION SERVICE
(a) The Recipient shall set a collection code ("the Code") upon the receipt of the Collection Notification via the hyperlink available in the Collection Notification. The Recipient shall provide the Code and corresponding item number for verification when collecting the postal item at the post office. The Recipient shall keep the Code confidential and shall not disclose it to any third party before picking up the postal item from the post office. The PMG shall not be liable for any loss, damage or expense suffered or incurred as a result of or incidental to the loss or disclosure of the Code to any third party by the Recipient.
(b) No redirection is allowed after the Customer selects the post office for collection of the postal item.
(c) Any postal item which is not collected within fourteen (14) days after the date of the Collection Notification will be returned to the Customer by the PMG. The Customer hereby acknowledges and authorizes the PMG to return the postal item to the Customer.
5. UNPAID AND UNDERPAID
(a) A postal item under the Smart Post Service posted unpaid or underpaid is forwarded and charged on delivery with the amount of the deficiency plus a fee equivalent to $4.
(b) Any postal item which is not collected within fourteen (14) days after the date of the Collection/ Call-for Notification will be returned to the Customer by the PMG. The postal item is charged on delivery with amount of the deficiency plus a fee equivalent to $4.
(c) The Customer is legally liable for any charges raised upon a postal item which has been posted either unpaid or underpaid, and if the addressee cannot be found, or if he refuses to pay the charges or accept the postal item, the charges can be recovered from the sender by legal process.
6. SMART POST SERVICE IN DESTINATION
(a) The Smart Post Service is available only for posting of postal items within Hong Kong.
(b) Provided that the destination for posting is within Hong Kong, the PMG agrees to deliver the Smart Post Service postal items at the service standards as stipulated in the Smart Post Service leaflet.
7. PACKING
(a) Every postal item shall be addressed in such manner and accompanied by such other documents as the PMG may require.
(b) Every postal item shall be made up in a reasonably strong cover appropriate to its contents, so that no part of the contents can be removed without either breaking or tearing the case, wrapper or cover, or forcing two adhesive surfaces apart, or breaking a seal.
(c) Any article contained in the postal item shall be adequately packed in order to be protected against damage in the course of transmission and in particular:
(i) An article which is of a fragile nature shall be packed in a container of sufficient strength and shall be surrounded in that container with sufficient and suitable material to protect the article against the effect of concussion, pressure and knocks to which postal items are ordinarily exposed in transmission, and the postal item shall bear the words "FRAGILE WITH CARE" written conspicuously in capital letters on the face of the cover above the address.
(ii) An article which is liable to be damaged by bending shall be packed in a container of sufficient strength to prevent the article from being bent in transmission, and the postal item shall bear the words "DO NOT BEND" written conspicuously in capital letters on the face of the cover above the address.
8. LIMIT ON SIZE AND WEIGHT
Every postal item shall comply with the size and weight limits of letter & small packet as laid down in Section 4 of Post Office Guide and in the Smart Post Service leaflet.
9. COMPENSATION
(a) The Conditions for compensation stated in Post Office Guide shall apply equally to the Smart Post Service and are incorporated herein by reference to the extent applicable.
(b) The PMG is not legally liable for the loss, damage, delay, non-delivery or misdelivery of anything sent by post, whether insured or not, or to pay compensation in respect of an insured packet (letter or parcel) or its contents.
(c) The PMG does not enter into a contract of carriage or of insurance either express or implied. It accepts postal items for transmission by post under, and subject to, the provisions of the Post Office Ordinance, and the Regulations and Rules made thereunder.
(d) The PMG is not liable when the sender’s actions may be suspected of fraudulent intent, aimed at receiving compensation.
(e) The decision of the PMG on all questions of compensation shall be final and conclusive.
10. EXEMPTION
Every postal item accepted for transmission under the Smart Post Service shall be delivered subject to the provisions of the Post Office Ordinance, and the Regulations and Rules made thereunder. In particular, the Customer’s attention is drawn to the exemption from liability provided for in section 7 of the said Ordinance which reads as follows:

(1) The Government shall not incur any liability by reason of the loss, non-delivery, misdelivery or delay of any postal item, or by reason of any damage to any postal item, whether registered or not.

(2) No officer of the Post Office shall incur any liability by reason of such loss, non-delivery, misdelivery, delay or damage, except in the case of fraud or wilful misbehaviour.

For the avoidance of doubt, it is expressly agreed by the PMG and the Customer that the postal item transmitted under the Smart Post Service is not a registered item.
11. PRECAUTIONS
The PMG shall take all reasonable precautions to prevent unauthorized persons from having access to the postal items or their contents and shall also take all reasonable precautions against loss of or damage to the same or their contents.
12. ENTIRE AGREEMENT
These Conditions of Service supersede all prior agreements, arrangements and undertakings between the parties and constitutes the entire agreement between the parties relating to the subject matter hereof.
13. VARIATION
These Conditions of Service are subject to variation, modifications and cancellation therein made by the PMG from time to time by leaflet or material displayed at the Post Offices or written communication by email to the email address as provided by the Customer and such variation, modification and cancellation shall be effective upon the display of such leaflet or material or upon transmission byemail.
14. GOVERNING VERSION
These Terms and Conditions are in both English and Chinese. Should there be any inconsistency between the two versions, the English version shall prevail.

Mail Collection Number
1. DEFINITION
Unless the context otherwise requires or permits, the following expressions shall have the following meanings:
(a)"Collection Notification" means the SMS sent by HKP to the Customer's Registered Mobile Phone Number to notify him/her for mail collection.
(b)"Corresponding Postal Address" means the postal, residential or correspondence address as provided by the Customer for the application of a Mail Collection Number.
(c)"Counter Collection Service" means the service provided by the PMG to the Customer in relation to the collection of a postal item as described in Clause 4 of these Terms and Conditions of Service.
(d)"Customer" means the person requesting the provision of a Mail Collection Number by the PMG, or the person who has completed the registration process to hold a Mail Collection Number regardless of usage.
(e)"EC-Ship Online Portal" means the EC-Ship website operated and administered by HKP at the https://ec-ship.hongkongpost.hk as may be modified, replaced or substituted from time to time by HKP.
(f)"Government" means the government of Hong Kong.
(g)"HKP" means the Post Office Trading Fund or Hongkong Post of the Government.
(h)"Hong Kong" means the Hong Kong Special Administrative Region of the People's Republic of China.
(i)"Intellectual Property Rights" means patents, trademarks, service marks, trade names, design rights, copyright, domain name, database rights, rights in know-how and other intellectual property rights of whatever nature and whosesoever arising, and whether now known or which created in future and in each case whether registered or unregistered and including applications for the grant of such rights.
(j)"iPostal Station" means HKP's self-serviced locker at designated locations in Hong Kong and from which mail item(s) can be delivered to by HKP and collected by the Customer.
(k)"Mail Collection Number Address" means the address format as described in sub-clause 3(m) of these Terms and Conditions of Service.
(l)"Mail Collection Number" or "MCN" means the Mail Collection Number provided by the PMG in accordance with the Terms and Conditions of Service as hereinafter appearing. A Mail Collection Number consists of an eight-digit number as assigned to the Customer by HKP.
(m)"MCN Sub-code" means the three-letter post office code of the Customer's Selected Post Office or the five-letter location code of the Customer's Selected iPostal Station.
(n)"Packet" is a mail item that meets both of the requirements below:
(i)it exceeds the weight and/or size limits as follows:

Weight: 500 g
Dimensions: 305 mm x 381 mm x 20 mm (thickness);
(ii) at the same time, it is within the weight and size limits as follows:

Weight: 2 kg
Dimensions: length, width and depth combined must not exceed 900 mm, and the greatest dimension must not exceed 600 mm
(For dimension requirements of packet in roll form, please refer to Section 4.2 of the Post Office Guide.)
(o)"Personal Data" has the meaning ascribed to it under the Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong).
(p)"Personal Information" means the personal information that a Customer is required to submit to HKP for or upon registration as a Customer of Mail Collection Number, and where appropriate, means such personal information as updated by the Customer at the EC-Ship Online Portal or otherwise notified to HKP.
(q)"PMG" means the Postmaster General or any duly authorised officer acting for and on behalf of the Government.
(r)"Post Office Working Day" means any day a respective post office is opened for business other than Sunday or a public holiday or the days when Black Rainstorm Warning or Tropical Cyclone Warning Signal No.8 or above are hoisted.
(s)"Registered Mobile Phone Number" means the mobile phone number provided by the Customer for registration of Mail Collection Number.
(t)"Selected iPostal Station" means the specific located iPostal Station selected by the Customer and confirmed on EC-Ship Online Portal as the valid selection at the time.
(u)"Selected Post Office" means the post office selected by the Customer and confirmed on EC-Ship Online Portal as the valid selection at the time.
(v)"SMS" means the text message sent by HKP (through service provided by any third parties (including without limitation, telecommunications companies, systems operators and internet service providers)) to the Customer's Registered Mobile Phone Number.
(w)"Terms and Conditions of Service" means the terms and conditions of Mail Collection Number contained in this document.
(x)"Working Day" means any day other than Sunday or a public holiday or the days when Black Rainstorm Warning or Tropical Cyclone Warning Signal No.8 or above are hoisted.
2. GENERAL TERM
(a)By applying for a Mail Collection Number, the Customer agrees to be bound by all of the Terms and Conditions of Service for the provision of Mail Collection Number.
(b)Upon registration as a holder of a Mail Collection Number, the Customer represents, undertakes and warrants to HKP that:
(i)the Personal Information the Customer has submitted to HKP is true, accurate and up-to-date;
(ii)the Customer has submitted his/her own Personal Information and not that of any other person to HKP;
(iii)the Customer shall notify HKP of any change in his/her Personal Information by updating his/her Mail Collection Number on EC-Ship Online Portal or in writing within the day of change;
(iv)the Customer shall take full responsibility for his/her Mail Collection Number and any actions taken or omissions through his/her Mail Collection Number.
(c)HKP may, at its absolute discretion, suspend or terminate the Customer's Mail Collection Number without prior notice in any of the following circumstances:
(i)any of his/her Personal Information is untrue, inaccurate, incomplete or out of date (or HKP has reasonable grounds to suspect that this is the case); and/or
(ii)HKP has reason to believe that he/she has used the Mail Collection Number illegally, improperly or not in accordance with these Terms and Conditions of Service.
(d)Neither the PMG, the Government, nor any of the telecommunications companies which may be designated by the PMG for the purposes of providing the SMS with confirmation code, will be liable for any failure or delay in transmitting information to the Customer or any error in such information. In particular, neither the PMG, the Government, nor any such telecommunications companies shall be held liable for any of the consequences arising from any force majeure event or any other cause beyond the reasonable control of the PMG, the Government, or such telecommunications companies including without limitation the failure of the Customer's telecommunications equipment to receive information for whatever reasons, any telecommunications breakdown, mechanical failure, path failure, malfunction, technical breakdown, interruption or accuracy of equipment or installation.
(e)The third parties (including without limitation, telecommunications companies, systems operators and internet service providers) supporting the provision of Mail Collection Number are not agents or partners of the PMG and do not represent the PMG. There is no agency, partnership, joint venture or other relationship between these third parties with the PMG. The PMG is not liable for any losses or damages, direct, indirect or consequential caused by any acts or omissions of the third parties.
(f)The terms and conditions for the provision of the EC-Ship Online Portal services shall apply equally to the provision of Mail Collection Number and are incorporated herein by reference to the extent applicable. Terms and expressions defined in the terms and conditions for the provision of the EC-Ship Online Portal services shall have the same meanings when used in these Terms and Conditions of Service for the provision of Mail Collection Number unless otherwise provided.
(g)The Customer agrees to comply with all laws, statutes and regulations whether of Hong Kong as applicable to any use of Mail Collection Number.
(h)The Customer shall indemnify HKP and keep HKP fully and effectively indemnified from and against all and any liabilities, losses, damage, costs, charges, expenses (including legal fees), demands, claims, proceedings and actions which HKP may sustain or incur or which may be brought or established against HKP by any person, and which in any case directly or indirectly arises out of or in connection with any of the following:
(i)the Customer's negligence, recklessness or wilful misconduct;
(ii)the Customer's breach or non-performance or non-observance of any provisions of these Terms and Conditions of Service;
(iii)the Customer's breach of any representation or warranty given by the Customer; or
(iv)any infringement by the Customer, the Customer's agent or contractor of the Intellectual Property Rights of HKP.
(i)Sub-clause 2(h) shall survive the termination of Mail Collection Number and shall continue in full force and effect notwithstanding such termination.
(j)Unauthorised copying, distribution, modification and public display of copyrighted works is an infringement of the copyright holders' rights. As a condition of the Customer's use of Mail Collection Number, the Customer agrees that he/she will not access or use or permit the Mail Collection Number to be accessed or used for infringing the intellectual property rights of others. Without prejudice to other accrued rights, HKP reserves the right to terminate the registration of any Mail Collection Number holder upon notice of any infringement of the copyright or other intellectual property rights of others in connection with the access or use of Mail Collection Number. HKP will investigate any information it receives in relation to copyright infringement committed by any holder or user of the Mail Collection Number.
3. APPLICATION FOR MAIL COLLECTION NUMBER
(a)Customer wishing to obtain a Mail Collection Number should register himself/herself as a user of the EC-Ship Online Portal and holds an account of the portal. The Customer can then apply for a Mail Collection Number. The PMG will only accept applications via the EC-Ship Online Portal.
(b)To apply for a Mail Collection Number, the Customer must provide the name same as that on his/her identification document, which is usually a Hong Kong identity card, but any one of the following is also acceptable :
(i)A valid travel document;
(ii)Other identification documents issued by the Government bearing a photograph of the Customer.
(c)Once the Customer provides his/her name as in sub-clause 3(b) above and Corresponding Postal Address for application, HKP will send within five (5) Working Days a letter with a verification code to the Corresponding Postal Address provided by the Customer. The Customer has to log on to EC-Ship Online Portal to enter the verification code.

The Customer will then be directed to the page where he/she is requested to provide a Registered Mobile Phone Number. Once the Customer provides his/her Registered Mobile Phone Number, HKP will send an SMS with a confirmation code to the mobile phone number the Customer provided during application. The Customer has to log on to EC-Ship Online Portal to enter the confirmation code and complete the registration process.

The Customer shall take all steps to safeguard the verification code and/or the confirmation code at all times. The Customer shall not disclose the verification code and/or the confirmation code to any other person or permit any other person to gain access to the application. The Customer shall not disclose the verification code and/or the confirmation code to anyone who claims to represent HKP or holds out as the authorised representative of HKP in any circumstances.
(d)The Customer shall provide to the PMG the correct Corresponding Postal Address for the receipt of the letter with his/her verification code. The PMG shall not be responsible for any failure or delay in sending the letter caused by any inaccurate or incomplete information provided by the Customer.
(e)The Customer shall provide to the PMG the correct and current mobile phone number for the receipt of the SMS with his/her confirmation code. The PMG shall not be responsible for any failure or delay in sending the SMS caused by any inaccurate or incomplete information provided by the Customer.
(f)Notwithstanding any other provisions in these Terms and Conditions of Service, the PMG is entitled to reject any application without giving any reason.
(g)The Customer has to select on EC-Ship Online Portal one post office for Counter Collection Service and/or one iPostal Station location for iPostal Station Service. Once the registration process is completed, the post office and/or iPostal Station at location selected will be confirmed on EC-Ship Online Portal as the Selected Post Office and/or the Selected iPostal Station respectively. The Customer will be assigned a Mail Collection Number consisting of an eight-digit number and a three-letter MCN Sub-code for the Selected Post Office and/or five-letter MCN Sub-code for the Selected iPostal Station.
(h)Mail types under the service scope of Mail Collection Number for Counter Collection Service (sub-clause 4(b)) and/or for iPostal Station Service (sub-clause 5(b)), if bearing a correct and valid Mail Collection Number Address, HKP will deliver to the Customer's Selected Post Office or Selected iPostal Station.

Mail types other than those specified at sub-clause 4(b) and/or sub-clause 5(b), even if bearing a correct and valid Mail Collection Number Address, HKP will deliver to the delivery address as appeared on the mail item. If there is no delivery address on the item, HKP will deliver it to the Corresponding Postal Address provided by the Customer at the time when they registered for the Mail Collection Number. If the Mail Collection Number on the mail item is incorrect or invalid, those items will either be returned to the sender if the sender address is given or be treated as undeliverable and disposed of if the sender address is not given.
(i)Mail Collection Number is operative by sending SMS to the Registered Mobile Phone Number. Registration of Mail Collection Number and mobile phone number are on one-to-one basis.
(j)Upon completion of registration, Mail Collection Number is assigned by HKP and cannot be changed.
(k)The Customer can change the Selected Post Office and/or the Selected iPostal Station on EC-Ship Online Portal. The change will take effect starting from the date chosen by the Customer and accepted by HKP for the newly-selected post office and/or newly-selected iPostal Station on EC-Ship Online Portal.

Mail items bearing codes and/or writings other than the correct and valid Mail Collection Number Address (including without limitation a correct and valid MCN Sub-code) will not be accepted by post offices. If mail items are posted via other channels or from overseas, HKP will endeavour to forward such mail items according to the Selected Post Office or the Selected iPostal Station.
(l)From the date of successful registration, Mail Collection Number must be re-activated every one (1) year so as to remain its validity.

HKP will send an SMS with a confirmation code to the Customer's Registered Mobile Phone Number. The Customer has to log on to EC-Ship Online Portal to enter the confirmation code to re-activate his/her Mail Collection Number by a date specified in the SMS.
(m)A correct and valid Mail Collection Number Address shall include the following:
(i)The Customer's name;
(ii)The Customer's postal, residential or correspondence address (not necessary for items posted locally);
(iii)The Customer's eight-digit Mail Collection Number which is correct and valid; and
(iv)The Customer's three-letter/five-letter MCN Sub-code which is correct and valid.
A Mail Collection Number Address must be typed or legibly written as in the examples given below:

4. COUNTER COLLECTION SERVICE
(a)Once assigned a Mail Collection Number and a MCN Sub-code, the holder can inform the senders of his/her mail to put the Mail Collection Number Address on mail items. For mail items as described at sub-clause 4(b), if bearing a correct and valid Mail Collection Number, HKP will deliver to the Customer's Selected Post Office. HKP will issue Collection Notification to the addressees concerned by SMS to collect such mail items at the Selected Post Office.
(b)Mail Collection Number (in cases where a post office is selected) is used for collecting mail at the Selected Post Office. It covers the following mail types:
(i)Local Ordinary Mail (Packets only);
(ii)International Ordinary Mail (Packets only);
(iii)Local Registered Mail;
(iv)International Registered Mail;
(v)Local Parcel;
(vi)International Parcel;
(vii)Smart Post Mail Delivery Service (only items within the weight and size limits of Packets);
(viii)EMS.
(c)Mail items bearing incorrect or invalid Mail Collection Number will be delivered to the delivery address, if there is, as appeared on the mail item. Those items without a delivery address will either be returned to the sender if the sender address is given or be treated as undeliverable and disposed of if the sender address is not given.
(d)When processing a mail item bearing a Mail Collection Number Address, HKP will only verify the Mail Collection Number, the MCN Sub-code and the mail type. Any other information provided on the mail item, including without limitation, the addressee's name and postal or residential or correspondence address, will not be verified by HKP.
(e)HKP will deliver any mail items bearing the Mail Collection Number with both the MCN Sub-codes of the Selected Post Office and the Selected iPostal Station to the Selected Post Office.
(f)Change of mail collection location is not allowed for items delivered to the Selected Post Office under the Mail Collection Number. HKP will not accept requests to forward or deliver the items to another post office, iPostal Station or any other locations.
(g)Mail Collection Number Address and/or Mail Collection Number and/or MCN Sub-code are not considered as a proper return address. Any undeliverable mail items bearing a return address in the format of Mail Collection Number Address and/or Mail Collection Number and/or MCN Sub-code will not be delivered to the Selected Post Office.
(h)HKP will issue Collection Notification by SMS to the Customer's Registered Mobile Phone Number to notify him/her when an item is available for collection at the Selected Post Office.
(i)Upon the receipt of the Collection Notification with a collection code, the Customer shall provide the Collection Notification SMS, the collection code and corresponding item number for verification when collecting the mail item at the Selected Post Office, the Customer shall keep the Collection Notification SMS and the collection code confidential and shall not disclose it to any third party except in cases when the Customer authorises an agent to collect the mail item on his/her behalf as described in sub-clause 4(j) before picking up the mail item from the Selected Post Office. The PMG shall not be liable for any loss, damage or expense suffered or incurred as a result of or incidental to the loss or disclosure of the collection code to any third party by the Customer.
(j)In addition to the Collection Notification, proof of identity is required when collecting Local Registered Mail; International Registered Mail; Local Parcel; International Parcel and EMS. Such proof is usually a Hong Kong identity card, but any one of the following is also acceptable :
(i)A valid travel document;
(ii)Other identification documents issued by the Government bearing a photograph of the holder.
The addressee who shall also be the Customer collecting such items personally must produce his/her original identification document. An agent collecting on behalf of an addressee must produce his/her own original identification document and either the original or a photostat copy of the identification document of the addressee.
Signature of receipt by the addressee or the agent collecting on behalf of an addressee is also required for collecting Local Registered Mail; International Registered Mail; Local Parcel; International Parcel and EMS.
(k)Any mail item which is not collected within the retention period after the date of the Collection Notification will be returned to the sender (if applicable) or treated as undeliverable and arranged for disposal. (l)Any parcel remaining unclaimed at the expiry of seven (7) Post Office Working Days from the issue of the Collection Notification shall be liable to demurrage charge. Please refer to Post Office Guide for details of demurrage charge.
(m)All unpaid or underpaid items or items subject to surcharge will be processed and delivered in accordance with the prevailing practice. Please refer to Post Office Guide for the handling of unpaid and underpaid items.
5. iPOSTAL STATION SERVICE
(a)Once assigned a Mail Collection Number and a MCN Sub-code, the holder can inform the senders of his/her mail to put the Mail Collection Number Address on mail items. For mail items as described at sub-clause 5(b), if bearing a correct and valid Mail Collection Number Address, HKP will deliver to the Customer's Selected iPostal Station or its nearby post office under the Terms and Conditions of Service as given in sub-clauses 5(j), 5(n), 5(r), 5(s). HKP will issue Collection Notification to the addressees concerned by SMS to collect such mail at the Selected iPostal Station or its nearby post office.
(b)Mail Collection Number (in cases where an iPostal Station location is selected) is used for collecting mail at the Selected iPostal Station. It covers the following mail types:
(i)Local Ordinary Mail (Packets only);
(ii)International Ordinary Mail (Packets only);
(iii)Local Parcel;
(iv)International Parcel;
(v)Smart Post Mail Delivery Service (only items within the weight and size limits of Packets);
(vi)EMS.
(c)Mail items bearing incorrect or invalid Mail Collection Number will be delivered to the delivery address, if there is, as appeared on the mail item. Those items without a delivery address will either be returned to the sender if the sender address is given or be treated as undeliverable and disposed of if the sender address is not given.
(d)When processing a mail item bearing a Mail Collection Number Address, HKP will only verify the Mail Collection Number, the MCN Sub-code and the mail type. Any other information provided on the mail item, including without limitation, the addressee name and postal or residential or correspondence address, will not be verified by HKP.
(e)HKP will issue Collection Notification by SMS to the Customer's Registered Mobile Phone Number to notify him/her when an item is available for collection at the Selected iPostal Station or its nearby post office.
(f)Change of collection location is not allowed for items delivered to the Selected iPostal Station or its nearby post office under the Mail Collection Number. HKP will not accept requests to forward or deliver the items to another post office, iPostal Station or any other locations.
(g)Mail Collection Number Address and/or Mail Collection Number and/or MCN Sub-code are not considered a proper return address. Any mail items bearing a return address in the format of Mail Collection Number Address and/or Mail Collection Number and/or MCN Sub-code will not be delivered to the Selected iPostal Station.
(h)Upon the receipt of the Collection Notification by SMS with a collection code notifying an item is available for collection at the Selected iPostal Station, the Customer shall input the collection code to the Selected iPostal Station for verification when collecting the mail item. The Customer shall keep the Collection Notification SMS and the collection code confidential and shall not disclose it to any third party before picking up the mail item from the Selected iPostal Station. The PMG shall not be liable for any loss, damage or expense suffered or incurred as a result of or incidental to the loss or disclosure of the collection code to any third party by the Customer.
(i)It is agreed that HKP will not provide signed proof of delivery, and the mail item is deemed delivered when:
(i)HKP issues the Collection Notification by SMS to the Customer's Registered Mobile Phone Number with a collection code (which is required to unlock the iPostal Station); and
(ii)the identified iPostal Station is unlocked and opened using the collection code provided.
(j)Upon the issuance of the Collection Notification by SMS with the collection code for collection at the Selected iPostal Station, the mail item will be made available for collection at the Selected iPostal Station for a period of four (4) calendar days from the date of the receiving notification. If the Customer fails to collect the mail item within the period stipulated, or such other period as may be stipulated in the Collection Notification, the mail item will be moved from that Selected iPostal Station to its nearby post office for counter collection.
(k)Upon the receipt of the Collection Notification with a collection code notifying an item is available for collection at the nearby post office, the Customer shall provide the Collection Notification SMS, the collection code and corresponding item number for verification when collecting the mail item at the nearby post office. Besides, the sub-clause 4(j) is applicable in collecting local parcel, international parcel and EMS items. The Customer shall keep the Collection Notification SMS and the collection code confidential and shall not disclose it to any third party except in cases when the Customer authorises an agent to collect the mail item on his/her behalf as described in sub-clause 4(j) (for mail types applicable to iPostal Station service) before picking up the mail item from the nearby post office. The PMG shall not be liable for any loss, damage or expense suffered or incurred as a result of or incidental to the loss or disclosure of the collection code to any third party by the Customer.
(l)Any mail item which is not collected within the retention period after the date of the item reaching the nearby post office will be returned to the sender (if applicable) or treated as undeliverable and arranged for disposal. Please refer to Post Office Guide and the terms and conditions of respective mail service for its retention period.
(m)Any parcel remaining unclaimed at the expiry of seven (7) Post Office Working Days from date of the parcel reaching the nearby post office shall be liable to demurrage charge. Please refer to Post Office Guide for details of demurrage charge.
(n)HKP will deliver the mail item to the available locker of Selected iPostal Station only if the dimension of the mail item can fit in the available locker (locker size of iPostal Station). Oversized MCN mail items, except EMS items which will be delivered to the delivery address as appeared on the EMS items, will be sent to the nearby post office for collection within the respective retention period.
(o)HKP reserves the right to review and amend the list of iPostal Stations and their nearby post offices from time to time and make changes thereof without any or prior notice to Customers and/or any third party.
(p)The Customer acknowledges and agrees that HKP shall have the right to shut down the iPostal Station facilities for any reason including regular maintenance. HKP shall not be liable for any loss or damage suffered, whether by the Customer or any third party, as a result of such closure.
(q)The mail item will be delivered into the Selected iPostal Station by priorities, the highest priority is EMS, the second priority is Parcel, the third priority is Smart Post and the last is Ordinary Mail.
(r)In case vacant locker of Selected iPostal Station is not available, MCN mail items, except EMS items which will be delivered to the delivery address as appeared on the EMS items, will be held by HKP for two (2) Working Days to wait for a vacant locker. If there is no vacant locker available after two (2) Working Days, the mail item will be sent to the nearby post office for collection within the respective retention period.
(s)iPostal Station Service is not guaranteed to be always available. In the event including, but not limited to the following:
(i)the mail item(s) do not fit into the locker of Selected iPostal Station in accordance with the condition mentioned in sub-clause 5(n);
(ii)all the suitable lockers at the Selected iPostal Station location are not available; or
(iii)HKP's iPostal Station is not available for any reason, including but not limited to reasons such as the system being out of service or shut down for maintenance.
(t)iPostal Station Service is not applicable to unpaid or underpaid items or items subject to surcharge and items in a damaged condition. All unpaid or underpaid items and items in a damaged condition will be processed in accordance with the prevailing practice. Please refer to relevant Sections of Post Office Guide.
(u)Please refer to EC-Ship Online Portal for iPostal Station locations and their nearby post offices.
6. COMPENSATION
(a)The terms and conditions for compensation stated in Post Office Guide are incorporated herein by reference to the extent applicable.
(b)The PMG gives no warranty or representation for and is not legally liable for the loss, damage, delay, non-delivery or misdelivery of anything sent by post, whether insured or not, or to pay compensation in respect of an insured packet (letter or parcel) or its contents.
(c)The PMG is not liable when the sender's actions may be suspected of fraudulent intent, aimed at receiving compensation.
(d)The decision of the PMG on all questions of compensation shall be final and conclusive.
7. MODIFICATION
HKP is entitled to delete, suspend or amend any or all of these Terms and Conditions of Service at its absolute discretion at any time and from time to time. The amended Terms and Conditions of Service will be effective immediately upon its posting on the EC-Ship Online Portal. If the Customer continues to use Mail Collection Number after the amendment, the Customer agrees or will be deemed to agree to be bound by these Terms and Conditions of Service. In this regard, the Customer is strongly advised to read these Terms and Conditions of Service carefully each time before the Customer uses Mail Collection Number.

iMail

iMail Service
Minimum Posting ThresholdThe number of items to be posted should be no less than 5 per destination and no less than 20 per posting; the average weight per item in the same posting should be no less than 100g. Therefore the minimum weight per posting should be 2 kg.

A Permit Number shall appear on the top right-hand corner of the envelop. The impression (40mm wide by 20mm high) is shown below.

Customers should prepare "Posting Statement of iMail Service" (Pos 487R) on EC-Ship Online Portal before posting. Printing of an extra copy of Pos 487R and "Certificate of Posting of iMail Service" (Pos 20(iMail)) is available for record purpose.

Permit mailing account on the posting statement and imprinted on mail items are used for identification as the same posting. For example, mail items sent in different consignments bearing the same permit mailing account will be counted as the same posting.
Payment method Permit Deposit Account, Cash, EPS, credit cards or cheques (by prior arrangement with Financial Services Division). Payment by postage stamp or postage label purchased from Postage Label Vending Machine (PLVM) is not applicable.
For payment by Permit Deposit Account, customers should maintain sufficient deposit for immediate postage settlement upon posting.

Mail Segregation Customers are required to segregate mail items by destination, i.e. each mail bag should contain items to the same destination.
With effect from 1 March 2019, posting arrangement for "residual bag" is discontinued.
If mailbags are found containing items to mixed destinations, Hongkong Post reserve the right to return the whole lodgement to senders.
Individual Mail Item and All-in-one Address Label All-in-one address labels including sender's and addressee's addresses, item barcode, permit number impression, customs declaration form (CN22/CN23) and air mail impression shall be printed through the EC-Ship Online Portal and affixed onto the front cover of each item. Using address labels NOT generated from EC-Ship Online Portal may subject to delay on mail handling and processing of compensation if applicable.
Mail should not bear a non-Hong Kong return address or enclose mail sent on behalf of other senders in Hong Kong.

We recommend printing address labels by using a laser printer for easy barcode scanning by Hongkong Post's computer system. We may not process the item further if we are unable to scan the barcode during Item Acceptance.
Bag Labels and Mailing SuppliesMail bags and bag labels can be collected for free at any Bulk Acceptance Offices. A bag label should be attached to each mail bag. Information including the date of posting, the permit number, destination, the bag number, the weight of each bag, the number of items should be clearly indicated on each bag label.
Item Level and Bag Level Checking The "Posting Statement of iMail Service" (Pos 487R) is required for acceptance on bag level. The acceptance process has not yet completed until mailbags are subsequently forwarded to the processing centre of Hongkong Post, where the mailbags are opened and acceptance on item level is performed. Postings not complying with iMail service posting Terms & Conditions would be returned to senders.
Bag Weight & Number of Item
  • The postage payable will be final subject to
    1. actual bag weight shown on the electronic scale of Hongkong Post;
    2. actual number of items checked by Hongkong Post;
    3. the prevailing (i) postage charge in kg; and (ii) the handling fee per item of the destination.
  • In the event that the paid amount fall short of the total postage charge payable, the sender shall make up the difference immediately. When the paid amount is in excess of the total postage charge payable, the sender shall complete and submit an "iMail Service Refund Application" form to the Financial Services Division of Hongkong Post for refund.

An "Acceptance Report for iMail Service" containing the confirmed total weight, charges and details of the posting items will be uploaded to the EC-Ship Online Portal after successfully scanning by the processing centre of Hongkong Post. The "Acceptance Report for iMail Service" will be uploaded within 3 working days (non-peak periods) or 7 working days (peak periods) after the date of posting.

General Information

The "Acceptance Report for iMail Service" is available for view and download within 6 months after the date of posting. Senders are advised to download and keep the report for record purpose.

Written proof of delivery is not provided under this service.
To ensure that mail in transport does not present danger to the general public, prohibited or dangerous articles must never be sent in the post. Prohibited or dangerous articles if detected during our processing, will be returned and the sender will not be entitled to any refund. The sender will in some cases be liable to prosecution. Details on the prohibitions are given in Section 6.3 of the Post Office Guide (https://www.hongkongpost.hk/filemanager/common/poguide/en/6.3.pdf).

Enquiries

Items can be traced starting from 2 weeks and within 5 months after the date of posting. All enquires must be made via the EC-ship Online Portal only. Enquiries via other channels such as submitting the enquiry form (Pos28B) or Pos28B attached to the leaflet Pos815 by post, fax or email, and completing the Pos28B enquiry form (pdf or online version) on the Hongkong Post’s website (https://www.hongkongpost.hk) will not be accepted.
In case of enquiry, you may
  1. access our website at https://www.hongkongpost.hk (under normal circumstances, only delivery status up to departure from Hong Kong will be provided), or
  2. call the enquiry hotline of Track and Trace System at 2921 2560, or
  3. complete and submit an online enquiry form on EC-ship Online Portal.
Under normal circumstances, overseas postal administrations may take two months to follow any tracing enquiries and four months to finalize the compensation procedures, if any. Hongkong Post will endeavor to follow up with overseas postal administrations for an early reply.

Compensation

In the event of damage or loss, the maximum compensation amount will be determined subject to the regulations of the Universal Postal Union. The compensation amount is the declared value on the Item Acceptance Report for iMail Service, or HK$320 at maximum (whichever is lower) plus the postage paid applicable to kg charge only, with the exception of item handling fees and insurance premiums. The claimant must provide relevant invoice to substantiate the value of the content. For details, please refer to Section 5.6 - "Compensation" under "Supplementary Services" Section of Post Office Guide available at our website at https://www.hongkongpost.hk.
Postage refund will be calculated based on the average postage charge per item of the same destination within the same posting, with the exception of item handling fees and insurance premiums
No application will be entertained for the refund of the postage on correspondence which is discovered, after Bag Acceptance is performed by service counter staff, to contain any prohibited article, or which exceeds the limit of size and weight, or which for any other reason cannot be forwarded and has consequently to be returned to the sender, and any loss resulting from a non-observance of the rules by the sender of an article must be borne by him.
Compensation, if applicable, will be made to senders only.

iMail Insurance Service

Hongkong Post will base on the posting information submitted by the customer via EC-ship Online Portal, insure iMail items requested online for iMail insurance service and confirmed receipt by Hongkong Post.
If compensation is made by Hongkong Post for the loss or damage to mail item(s), the amount of which will be deducted from the total claim amount paid by the insurer.
Hongkong Post will only insure a batch of iMail items of which all the related charges (including postage, item handling fee and premium) have been settled. In case the charges paid fall short of the confirmed charges, the sender shall make up the difference immediately to ensure that items requiring iMail Insurance will be insured.
Senders may refer to the Item Acceptance Report for iMail Service which is available for download online for the details of the insured items.

Dispute

In case of dispute or anomalous enquiries, Hongkong Post reserves the right to ask the sender to provide a written declaration of non-receipt of mail items from the recipient. The Item Acceptance Report for iMail Service provided on Hongkong Post Website shall be final.
Hongkong Post reserves the right to amend the Terms and Conditions above at its sole discretion. In case of discrepancies between different versions of these Terms & Conditions, the final version published on the Hongkong Post’s website shall prevail.

Definition

"Bag Acceptance" means the process of receiving a mailbag after successfully reading the barcode on the "Posting Statement of iMail Service" (Pos 487R) or "Certificate of Posting for iMail Service" (Pos 20 iMail).
"Item Acceptance" means the process of receiving a mail item after successfully reading the barcode on the address label.

Personal Information Collection Statement

Provision of personal data in response to Hongkong Post's request is required for provision of the required service. All the posting details including the personal data may be transmitted via electronic data interchange to the overseas postal administrations which have a business relationship with Hongkong Post and the transit as well as destination countries' Customs Authorities. If you do not provide the Personal Data, Hongkong Post will be unable to provide the required service. Personal data include without limitation the information such as sender / addressee's name, residential and company address, telephone number and e-mail address.
Hongkong Post would not use the personal data for any other purposes without customer prior consent unless such use is permitted or required by law. Except that, Hongkong Post's general policy is to disclose no personal identifiable information to third parties except as required by law.
You agree that any of your Personal Data collected by Hongkong Post through your use of the Online Portal or the Services at any time and from time to time may be used for such purposes and disclosed to such Persons in accordance with Hongkong Post's Personal data collection and privacy policies set out in the Privacy Policy Statement published under Hongkong Post's website at https://www.hongkongpost.hk/en/privacy/index.html which may be modified from time to time.
You have the right to request access to and correction of your personal data in accordance with Sections 18 and 22 and Principle 6 in Schedule 1 to the Personal Data (Privacy) Ordinance (Cap. 486). Your right of access includes the right to obtain a copy of your personal data as provided in this Address Pack.
